    That's why you lost.  We never, ever ever ever ever tell people to accept a hearing on the papers.

    You even had the fake £60 allowed against you.  Never happens at an attended hearing.

    If you cannot tell us why you lost we cannot help.  The judge appears to have awarded the PPC unlawful costs for debt collection, is that so?  Have you read Excel v Wilkinson?  

    We advise to never ever agree to a papers hearing for the reason you have now discovered.  
    You never know how far you can go until you go too far.

     I made reference to the excel v Wilkinson as part of my defence. It appears the judge didn't consider any of my defence.

    Is the case not decided upon facts and arguments outlined in the defence papers?

    Please can you explain how attending can change the outcome, as you are arguing the facts written in your defence?

    All I can say is that your defence must have been week.  Does anyone know what redresss a defendant has when a judge awards unlawwful amounts?

  • Hi, yes I followed the process after many hours of reading the newbies & various defences, providing witness statements & lots of evidence. 

    It appears the judge dismissed all my points raised.

    I made reference to Excel v Wilkinson including a copy of the judgement,  but the abuse of process clearly doesn't apply in every case.

    I was under the impression if a court made a judgment it would set a precedence for future cases ? 

    But yet the judge awarded total costs of £260, a complete contradiction in Excel v Wilkinson.

    My main point was Primacy of Contract and that vcs could not override my existing tenancy agreement as in  Pace v Mr N.

    County Court cases don't set a precedent. Only higher courts.
