VCS County Court Claim HELP

Hi, please could I get some clarification on deadline dates.

1, Court claimed received dated 5th March 2021
2, Acknowledgment of Service received 22nd Mrch 2021

Do I have 28 days from AOS received, or have I missed the deadline ? :/

Many thanks,

Tom.

    Hello and welcome.

I am going to assume that the Claim was Issued on 5th March, and therefore received a couple of days later.

With a Claim Issue Date of 5th March, and having filed an Acknowledgment of Service in a timely manner, you had until 4pm on Wednesday 7th April 2021 to file your Defence.
That was the middle of last week.
Since then the Claimant has been free to seek a Default Judgment against you. Your MCOL Claim History will tell you if that has happened.

Your best bet is to file a Defence now, this weekend, before 8am tomorrow morning.
To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.

The good news is that nothing else untoward will happen until tomorrow morning.

Get working on that Defence now.
  • Hi,

many thanks for your swift replies.

I have checked on the web, the last transaction was AOS received on 22nd March.

I will crack on with the defence tonight and submit it.

    Nothing to lose.

    Thanks again.
  • Just a quick question. If you email the defence as attachment, do you still need to complete the steps on MCOL ? Thanks

OK but don't miss reading what to do next. It is all shown under the red heading in the NEWBIES thread, about what to do when.

No asking us about the tedious DQ and whether to agree to Mediation, etc.  And no being late with your WS & evidence!

It would also help to know a little more about the claim, as we havent even seen your defence yet!

Hi, received yet another letter from VCS advising that ELMS Legal are no longer representing them. They are willing to accpet a reduced amount of £175 to avoid court. They will also bring this to the attention of the court on the question of costs.

Is this standard for them ?

    Thank you
