Coupon-mad, I'm sorry if I have offended you in any way, I would point out however, that it was you who pointed me in the direction of bargepole's wording. I am, I must admit struggling to find your template, or indeed the draft WS by @Rickybalboa and @Jerm9218, this is likley due to my inability to correctly use the search engine on the forum, any help in this direction would be very much appreciated.

I can't find anything relevant either when I click on those usernames.

I can't can't find any posts or threads by Rickybalboa at all, and I can only find defence paragraphs but no WS when I search using Jerm9218's username.

Neither can I, having noted the posters' names for later research, only @Jerm9218 has a discussion and  @Rickybalboa has nothing at all.

That's him!  Sorry all, my excuse is that the auto-suggested version if the username found the wrong Ricky!  Final WS just posted by the right 'ricky' on his thread this weekend, after a lot of work.

Apologies @Dotage, things have changed week to week recently as we develop wording.  Ine minute it was 'here's a paragraph to include about the banned costs' and the next minute we have a new defence and now people are adapting it into their WS.

To try to help you, I was recalling cases off the top of my head  (aka winging it!) and now see that Jerm's case is a good example of a new-version defence (which you don't need) and the one by @ricky_balboa is a recent example of a worked through WS (that you do need).

Click on his username, it's in blue so it's a link to his profile.

The older WS posted in 2021 by @jryhs is worth you looking at too, because he shows the whole bundle, contents page, the lot including headings.  But he didn't have the advantage of the Govt having banned pseudo 'debt recovery' costs add-ons.

I suggest you make the comment that the contract upon which the claimant relies does not permit them to recover charges from the keeper more prominent, and that the driver has not been identified by the claimant.

They cannot claim monies from the keeper, only from the driver, and it is their responsibility to ensure they have brought a claim against the correct party.

It's headed up as a 'Supplementary' WS yet it's 7 pages long.  What point were you intending to add that wasn't in your first WS?
