Very sorry to have to report that I lost the case, the judge informed me at the outset that he was not obliged to follow any
judgement made by other courts, and that he had read everything submitted, and then gave me ten minutes to reach an agerrment with the other side, whilst he had a cup of coffee. I did not reach an agreement with the other side, so we went through a very one sided hearing, where all my points were dismissed, and with regard to the claimant having the right to issue a parking charge to the keeper, and having the right to pursue a known named driver to court, but having no right to pursue a court claim against the keeper; the judge informed me that it had no bearing on this case, and was only relavant to the land owner and parking company. Needless to say, I was very disappointed, and feel I have been very badly served by the justice system.

Sorry to hear this ... this is one of the downsides of court action - you get Judge Bingo and sometimes get one who is completely clueless. :(

What were you eventually ordered to pay? (Hopefully the fraudulent "debt collection" costs were removed).

Wasn't DJ Swan at Middlesbrough, was it?

There are very few dinosaur Judges left who are so taken in by parking firms.  Bad luck.  Nothing you could have said can change the outcome when you get the short straw of an opinionated Judge who is clueless enough to think that the false extortionate debt recovery costs are allowable on top of an already increased parking charge.

Luckily, the DLUHC listened and in future, the fake costs are banned by the will of the Government.  Without going into detail about the work of the new Code or what was said, it was like banging my head against a brick wall at first though...
