hju456 .... you have nicely laid out the circle of events.

This is of course the latest craze .... musical chairs with these complete idiots.

DCBL won't have a clue what is going on, they are simply robo claimers.  DCBL are now becoming a big joke here ... they issue a claim, they sign it as a statement of truth ....... they add a fake amount of £60 which is unlawful and DCBL have never been able to provide their legal authority to do so

THIS MEANS IN SIMPLE WORDS .... THE CLAIM IS FAKE AND UNRELIABLE ..

Get to grips with this scam .... some reading for you

QUESTION ...... will DCBL win with these old parking tickets .... probably not .... not when a claim is fake

Thank you Beamerguy for responding. As stated, my Court Claim has been received and acknowledged.
Since then I have been reading many posts on this forum to educate myself. Quite addictive it is too. I have
already read two threads you have highlighted . It seems the Courts are being flooded with claims at the moment, and hopefully more and more Judges will wake up to the dubious actions of both the PPC and the legal firms that they instruct. Thank you again for taking the time to read my thread and steering me in the right direction.

Any thoughts about point 7 in my 1st post. I think it is deliberately misleading.
Save it for the witness statement , concentrate on your paragraphs 2 and 3 for now , your defence should be concise and be a response to the POC , the PCN , and legal points , plus set the scene of the car park on the day , concisely , opening the door to the witness statement plus exhibits later on

Actually, Parliament has already woken up to the egregious activities within this worthless sector, culminating in the Parking (Code of Practice) Act 2019 and, (to be introduced later in the year) the out-workings of it.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Am I understanding correctly that my defence is Couponmads template in its entirety with paras 2&3 laying out my own circumstances?

More or less , you are providing bespoke paragraphs about your case , the rest are embedded as well in the final draft , none of the others are altered , edited or removed , just the 2 she left for victims like you

Thank you Redx. Seems I’ve got a lot of typing to do. Will get on it over next few days.👍

Yes. #2 should state that the D was not the driver, if that is true.

#3 should state what sort of car park this was and if the keeper Defendant knows why the driver briefly drove in and out of the area (only a few minutes, so it can be said that the D believes no contract was accepted).  If the D knows that the driver was merely collecting or dropping off a passenger or loading/unloading or delivering an item, or that a resident had asked for (authorised) them to visit but the resident didn't have a visitors-'s permit handy, or whatever, then say what you know as keeper.

I would add a concise #4 about the ZZPS letter stating that the PCN had been cancelled and that the D certainly did not ignore the matter but at all times pointed out that there could be no cause of action against a registered keeper in the absence of a timely and POFA-compliant Notice to Keeper.

I'd send a SAR to ZZPS as well and ask for all letters sent and all case notes and communications to and from OPS about your case and what led to the statement 'the parking charge is cancelled' in their letter.

Oh, I forgot to add, I am in Sussex and deal with OPS cases all the time, and in 2017 there was a pattern of no NTKs arriving. I recall several people with incidents in 2017 reporting that they didn't get a PCN or NTK and the first letter was a debt demand.  The fact you were bizarrely sent a very late NTK suggests this is what happened.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Thank you Coupon-mad,
Very good informative, I had not considered firing off a SAR to ZZPS, but will do.
When the first letter from ZZPS arrived,I remember visiting this forum, and you are correct ,there were several posts regarding lack of Ntd .
I will post my defence (just my circumstance) once I have finished it.
I am using an I-pad,but do not know how to copy the full defence as advised.

Ideally use a laptop , not a tablet or phone , meaning use the correct tools for the job

At the moment you have been advised to post 3 paragraphs , not a lot of typing
There is no need to post the rest of the template defence on here , only your few paragraphs

When approved , slot them into the template defence in place of 2 & 3 and renumber , digital signature to be added , then saved as a pdf to be emailed to the ccbcaq email address
