I had my hearing via CVP yesterday against OPS and DCB Legal and I will later today or tomorrow submit a report of how everything progressed.
First can I say thank you to the following contributors, SayNoToPCN, Le-Kirk, Beamerguy, RedX, Umkomaas, Coupon-Mad, and Fruitcake. A special thank you goes out to Keith-P for ensuring everyone complies with timelines, an unenviable task but crucial to all who visit this site..

Even after the appalling appeal decision OPS effectively threw a 70 year old lady's money at (to get a top parking savvy barrister to use a hundred year old, ancient and arguably dead piece of law about 'ticket cases' to walk all over the evidence that pointed the other way in a case I'd won hands down) Worthing Court DJs are not falling over themselves to get in line and let OPS win every case, then.
Tell us which Judge as well if you can remember, when you do your court report. Can't wait!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Leading up to the hearing. Once the Hearing date was confirmed I wrote to DCB Legal and enclosed my NTK which was non compliant and enclosed a compliant NTK that I found on this forum both issued by OPS. I invited them to spot the difference. They did not reply
Four weeks later sent similar letter and also requested breakdown of “additional charges.
Reply from DCB Legal did not address the “additional charges “ but they stated the NTK was compliant because it had been sent within 14 days.
I expressed my concern that a firm of Solicitors have not understood POFA. In all three letters I invited them to discontinue as they had no legal standing to continue with the claim. I made it clear that these communications would be put before the Judge.
It is important to show the Court that you have done all that you can to avoid the Hearing. In my case the Judge reflected on these letters and my effort to avoid wasting the Courts time and it highlighted the shortcomings of both the Claimant and their Solicitors.- As we are aware most of the legal representatives are pretty poor at responding and when they do it is normally bs. So whilst it can be tedious to keep writing to the Legals it can as in my case be very advantageous at the hearing. There is nothing to be lost in showing the Court that you have tried right to the end to avoid a Court Hearing. Remember copy and save all correspondence from the the first letter you receive as the Judge was impressed that I had saved and responded to each and every letter and presented them in my WS. No less that 11 letters sent by myself informed OPS and the bottom feeders I was not the driver.
- I am aware that many contributors on here are of the opinion that any letter from bottom feeders can be ignored up until a Letter of Claim and I respect their opinions. However the Judge commented to me that my concerns over POFA were brought to the attention of all involved and on a consistent basis over a four year period. If you are confident you are correct and want to go all the way I believe constant communication can do you no harm.
DCB Legal’s WS was received by e-mail with 2 hours to spare. I had expected this so my WS was written before I had seen theirs.
My WS included all correspondence in chronological order from both sides, photos from site, POFA,
Case Law and transcripts along with the vehicle insurance from 2017 which had two people named my wife and my daughter (get out of that one).🤣
As I have already said keeping paperwork can really assist you.
DCB Legal then produced a Supplement Witness Statement 8 days before the hearing without making an application. This would prove to be a poor decision as I will explain later.
For the benefit of people that have not yet had their hearing: CVPYou are in Court and I would recommend that you dress accordingly, when the link opens up the Judge will consciously or sub-consciously have his first vision of you. They expect you to respect the Court and you should.
The Court will send you details of how to download the app and supply you with a room code and PIN number. At least a week before run a test connection. If you are unsure as I was then they supply a helpline number. The advice was excellent and they said if you experience any problems on the day of the hearing call again. You should be aware that if on the day it states “incorrect pin” don’t panic as it means they are not ready for you to join ( I did panic). The Court rang me and asked if I was ready to join please enter my PIN number. Entered PIN number.......nothing......more panic.
It turned out the the room number they had issued to me was different to what they had....doh!!After a short while and total silence on the other end of the line they connected me...
The Madam Usher informed me that the Judge would be connecting soon and I must not make any recording of the hearing. If the video link went down or I had issues my end there is a text facility to inform the CourtSorry if this part of the post is deemed unnecessary but if it assists just one person then it could be another victim saved.
