    I have just returned from work and waiting for me was the following from Worthing Court.

    ” You have stated that you have submitted the defence by email however unfortunately the defence was not sent with the file when transferred to Worthing. The District Judge has requested that you submit a further copy to the Court.” (Which of course I will comply with).

    I have checked on Mcol and it is showing as submitted as off the 19 April 2021. I also have received a confirmation  email, and telephone confirmation on the day I sent it.

    I was wondering if I should resend a copy to the Claimant’s Solicitor also.

    Looks like a CCBC failure to me.
    Just send a copy of your Defence to the Worthing Court.
    No need to send a copy to the Claimant's solicitor. The case would not have reached your local court if the Claimant hadn't seen your Defence.

    Have you a hearing date yet? Probably not.

    How is your Witness Statement and evidence gathering coming along?

    No date yet Keith, but I am considering applying to change Court after the recent appeal ruling.

    All photos and and letters sent/received have been indexed .
    Case laws have been saved to Dropbox.
    The rest can be tended to in response to the Claimant’s WS.

    I emailed DCBL a few weeks back stating they had a duty to assist the Court and that the Ppc had been informed from first contact that they have not complied with POFA and as such they have no cause of action that can be brought against the keeper.  Each and every beggar were told in writing.
    Of course DCBL have not responded but that will only help me if it runs all the way to a hearing.

    They don't respond if they don't know what to say. Perfect for the judge to ask the same question 

    DCBL are not very good with their robo claims

    I wouldn’t change court, there are good Judges at Worthing.

    The Circuit Judges seem to be easily led by parking firms but the DJs know what they are doing.  I’ve won at Worthing on a detail of the POFA and the lady Judge knew what I was talking about.
