Thanks :-)
So since I know that this contract they've sent me isn't with the land owner as I've spoken to the other party who have told me so, how should I play it? In the possible event that they do have a further contract that flows down from the actual landowner, would I even want to highlight this issue or should I say nothing and just wait until it comes out in court when it's too late for them to produce it?
I'm also skeptical of this third party as they're a property management company and I wouldn't be surprised if they're in it together. I don't think they were very happy about having their confidentiality broken with OPS, but that's neither my fault nor my problem...{Signature removed by Forum Team - if you are not sure why we have removed your signature, it's probably Gladstones}1 -
No landowner authority is already in the template defence and is a regular feature in these cases , as was seen in the VCS airport case earlier this week
Save your ammo for the WS plus Exhibits stage , which is where it goes to the nominated local court and to the claimant or their solicitors2 -
You can't hijack them in court. Everything each side wishes to rely on must be shared between them and with the court beforehand.
or should I say nothing and just wait until it comes out in court when it's too late for them to produce it?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Great, thanks. Also, if all of OPS's contracts are redacted in the same way as PDF's (in that they are actually NOT redacted), I could probably open up every one of them.....{Signature removed by Forum Team - if you are not sure why we have removed your signature, it's probably Gladstones}2

Have a look at Sections 43 and 44 of the Companies Act 2006 with regards to contract/document signatories, and who is authorised to sign/form a contract.
Both Acts are very short.
Also have a look at the thread by Johnersh, who is a solicitor, about redactions and the persuasive appeal court case of Hancock vs Promontoria.

I am happy to look at the contract myself with that regard, or you can search for other threads where I have commented on contracts using my username and the keywords, Section 43 Section 44 Companies Act 2006.
Have you managed to identify the actual landowner yet?
I married my cousin. I had to...I don't have a sister.

Thanks, I will have a look. No I haven't identified the landowner. All I know is that this property company no longer manage that land for them.{Signature removed by Forum Team - if you are not sure why we have removed your signature, it's probably Gladstones}1
