However they're saying that you're likely to be lucky and only receive a Fixed Penalty Notice of 3 points and £100

He won't be lucky. He'll simply be dealt with in line with the guidelines issued by the National Police Chiefs' Council. And yes, the FP is £100.

It seems obvious to me ... IF you receive a notification that they're seeking to prosecute in court THEN the Band B guidelines will apply (based on the actual speed vs limit). However they're saying that you're likely to be lucky and only receive a Fixed Penalty Notice of 3 points and £100 (?) fine. (That speed is way over the option for a Speed Awareness course).

If you already have 3 points then you should already know better ... there's no excuse whatsoever for 49 in a 30 limit.
Yeah i Am totally agree with you with that. Just silly speed for no reason whatsoever!!
I do have 3 points already, and I thought I did learn my lesson- obviously I didn’t. But I definitely have now. Not worth it at all!!

I just hope that they didn’t register me anymore than 49 then!

I would be lucky if I got 3 points and £100 fine as opposed to a 4-6 fine and summoned to court with a hefty bill. Either one, isn’t great and id rather have neither. But it’s my own fault.

does anyone have a website they could share which states that 49 is the cut off point for the 3 points and £100 fine. I cannot find one anywhere. All I see is contradicting answers.

in addition, is 49MPH the cut off point, or is it 50

thanks so far for your answers/help guys. I really appreciate it

There's nothing authoritative, but this is the table that's usually taken as such. First time I saw this, it was being shared by a barrister specialising in traffic law, so...

    As you can see...
Blue column - below 35, you're safe. 35+, FPN unless tea and biccies.
Green columns - 35-42, tea and biccies where appropriate.
Pink column - 50mph and above, summons (actually SJPN these days).

So above the blue 35, below the pink 50, no tea and biccies...? FPN. 3pts, £100.

thanks for that. Really helpful ! :) so hopefuly, if I have any luck(if you can say that), it’ll just be 3 points and £100
  • What dash cam do you have but you can also google how accurate that is.
I hope you don't get banned but equally, I do hope you are more careful in the future.
    Take care.

Pointless to speculate about the penalty when you don't even know at this point if the mobile unit actually got you. Wait until you get the notification and deal with it then.

That table is indeed authoritative - it comes from an ACPO document, recently re-published by the National Police Chiefs' Council. It needs to be seen in the context of an 11-page paper which stresses that these are guidelines and not the law. Having said that, they do seem to be followed pretty rigidly. https://www.npcc.police.uk/2018 FOI/Operations/030 18 Speed Enforcement Guidance.pdf

I was doing about 85 on the A64 (York bypass) a few months ago when I (belatedly!) noticed a Police camera van on a bridge just ahead of me. It was 08.00am Sunday morning, hardly anything else on the road and I was convinced I’d probably been ‘snapped’;...bang to rights.

The A64 is notorious  for speed enforcement methods i.e; plain-clothes police cars/camera vans/handheld speed-guns et al and I’m well aware of how stringently that stretch of dual carriageway is policed, which made my own transgression all the more annoying. I hear tell there’s a Traffic Cop  training  establishment in the area and the A64 is their proving ground.

I’m normally very conscientious but on that occasion I had an early morning head-up-@rse few minutes,...no defence whatsoever. I spent the next couple of weeks fully expecting a speeding NIP  but to my great surprise and relief no letter appeared.

This thread (and my own unpunished transgression!) has got me wondering just how the Speed vans actually operate (logistically and technically) and what are their limitations? Are they parked and left unattended or is there always a Rozzer in attendance?

The article below quotes: “For technical reasons, a speed van will only remain in a certain spot for 90 minutes” ...what’s all that about?

It’s begs the question: ..for how much of that  90 minutes is the camera actively monitoring the passing traffic ?

According to the article the speed van in question spends more than half the day being driven to various spots and presumably being set-up (however long that takes) for each  particular location.

Moral of the tale, @Arsenal2019 :  “ there’s maybe hope for you yet “ 😉
