    That makes sense, thank you.  I'm not sure in that case what the Newbies post means when it says, "This is a chance to see the PPC's hand" - what should I hope to achieve from the request that I don't already have?  Or is it just a delay tactic?

    It shows you everything they are going to rely on later in court. 

    All the photos, and the letters, you can check if the NTK was POFA compliant, etc. and whether the photos were taken over a 2 minute period or whatever.    Getting a SAR obviously gives lots of people some very useful info about how to word their defences and sometimes, a PPC drops the case when they are asked to provide a SAR, because they probably realise they have scant evidence!.

    OK, today I have sent a complaint to Trading Standards about NPE and TNC / CIS.  My complaint read, "I would like to report Unity Property Ltd (trading as TNC Collections and Credit Investigation Services (UK)) and their associated company National Parking Enforcement Ltd for predatory and misleading practices relating to an alleged parking offence.  They are repeatedly threatening to "issue a summons" which I understand only a court can do."  [I sent 2 separate complaints with very similar wording, one about NPE and one about Unity Property but both mentioning the other company.]

    I have also reported NPE to the IPC with a complaint reading, "National Parking Enforcement Ltd, along with their associated company Unity Property Ltd (trading as TNC Collections and Credit Investigation Services (UK) are repeatedly sending threatening letters with wording such as "...intention to instruct solicitors to issue summons" and "...if the debt shown above is paid prior to the issue of the County Court Summons".  My understanding is that only a court can issue a summons, yet NPE and their solicitors on their behalf are suggesting they intend to issue one.  I find this behaviour misleading, threatening and predatory."

    Let's see if anything comes of either.

    Interesting.  I already have an open complaint about that, put in last year, still not resolved even though the BPA admitted (after a bit of explanation and they looked it up) that they agree with me about the word 'summons'.

  • OK, I realise this thread is nearly two years old now, but over the weekend I received what I believe to be the actual real thing!  A letter entitled "LETTER BEFORE ACTION", with wording including, "We will be commencing Legal Action..." with a 30 day deadline to pay the outstanding amount.  Sorry to drag folks back into this, but I think I'm at the next stage...

    I have already submitted a SAR after their previous letter, and received a response on 13th May 2021.  It didn't include anything they hadn't already sent me - there are a series of CCTV photos showing my car arriving and parking at 19:51, and leaving at 20:30 the same day.  Notably they didn't include a photo of the sign on the day in question, despite me asking specifically for it.

    I'm now starting to get my head around what will be required should it get to court (never been in any sort of court before).  But prior to that, how should I proceed?  One of their reply forms only asks me to answer about the debt...

    "Section 1. Do you owe the debt?"
    (options: A I agree I owe the debt; B I owe some of the debt; C I don't know; D I dispute the debt.)

    Since I obviously dispute it, then it's straight to "Section 4. What documents are you sending with this form:  What information do you need?"

    Do I need to fill this form in at all, or should I simply ignore it along with the other enclosed form asking for financial details?  And then wait for the actual claim to come through?

    ...and when you read that post that @Le_Kirk has pointed you towards, you will see that you do not complete their forms.
  • Thank you both.  I was just a bit unsure as I've already submitted and received a response to the SAR but it didn't include a copy of what I can only assume is their actual evidence - what the sign said on the day.

    I guess I'll ignore the latest letter with forms, and wait for an actual court claim.
