HEARING LOST in a PCN dispute

Today's Judge in Bromley County Court was in no way to help motorists. Isn't it a good sign when the judge's first comment is "have you been using those PCN websites"?

Well, I have not studied a law degree to come here (I have only thought about that and I have not said it), obviously I have navigated and I have received advice from people who have dedicated many hours to acquire knowledge.

The judge has used the Beavis case to dismantle all my WS and my defense in order to legitimize CEL to collect PCN with their respective interests.

The court has accepted the Claimant's poor points to accept that he has demonstrated his connection to the landowner through a contract that he has not presented.

The judge has repeated the Beavis case several times and especially the search for data on the Internet "like many other cases that I have already seen in this court," he said.

The judge did not have a copy of any of our WS and a copy of my WS has been given to the judge by the claimant who has admitted that he had written on it. When I have offered my copy to the judge, he has denied it. With which, I do not know what copy was given to the judge of my WS, if there were any pages missing, if there was something modified... or simply without knowing what the CEL lawyer had written on it

And that's how the hearing has gone... with a total of 231 pounds that I have to pay... well, now I have to go to work, I'll write it up in more detail.

Really sorry to hear that OP. Sounds like you drew the short straw with regards to the 'Learned' Judge!

OH WOW, this is very sad, a judge who lives in the dark ages
He really should be advised to carefully read sites like MSE to fully understand the great parking scam he supports

Bromley County Court is clearly to be black balled in future

His understanding of the Supreme Court ruling is pathetic.

I'm sure you know that the Supreme Court ruled that £85 WAS acceptable as it included the operation of the scheme

The Supreme court NEVER ruled that £100 plus fake add-ons was fair, there was never such a case ........ What planet is this fella from and should the MoJ farm him out to the fields with cows who chew on the cud ??  Adding methane to our planet and it's people

We do know that judges read this forum ... are they surprised a judge approves these scammers ? ARE THEY ASHAMED ?

I'll open another thread explaining the hearing properly in Bromley County Court (A place to avoid). Because at the end of the day, I have to pay £231 for a car park where the first two hours are free for customers (refundable, if you find the signals in the blind spot....) and where I bought from the store (Morrison) and was only there for 40 minutes... But the judge was very against it and just worried because of these kind of websites where drivers get help…. I wonder if the parking owner who has 8 million pounds of profit (6 million in fines and 2 million in parking fees) with only 1 worker on his staff (one that changes every few years....) gives nice bonuses to "theier friends"...

When I said "the claimant is using the court system as a means of supposed debt recovery" the claimant's lawyer said "obviously this is a business model and there is nothing wrong with it" and the judge just didn't care absolutely. ...

After all, the Law is for those who cannot afford a good lawyer, however, justice is for those who can afford it.

Like I said, I'll explain it a little better with photos etc... It's a shame, but it is what it is. Whoever makes this kind of profit by scamming people and circumventing the law, he can buy whatever they wants...

at this location in 2023 I paid for a ticket but the said it wasn't done quick enough!!

I won  POPLA  appeal  my appeal was long as per helpful template here, in addition I noticed signage had a number of different parking company names on them, adjudicator allowed on this one point, and so didn't feel the need to be considered all the other points, parking company however still kept sending debt letters and now years later a letter before action,  I will go to court

If you won at Popla, complain using the complaints link on the BPA AOS members list, regarding their breach of the BPA CoP, wait for the reply, if they don't take action, complain online to the BPA AOS compliance team

Which parking company. , ?  Was it from CEL. ?

That is shockingly bad that the judge accepted the PCN scammer's annotated copy of the defence documents.
