    With an issue date of 24/12/20, the NtK would be deemed delivered on 30/12/20, so within the 14 days PoFA timescale beginning with the day immediately following the date of the parking event - unless you can prove otherwise (possibly check any date of posting showing on the envelope), but if not, it's 30/12.

  • I received the NTK on the 9/1/21 2 days after the date to make the lower payment, but how do you prove it ( no time marks on letters)

    You can write to the PPC complaining, and, if this goes to court, show the letter to the judge when alleging unreasonable behaviour. 
    You never know how far you can go until you go too far.

    You can't, so move on from that.

    ECP will assume that the keeper of the vehicle and Driver of the vehicle were the same person

    If this assumption is true , ECP will also state that POFA does not apply and they had 6 months to obtain keeper details and one month to get the NTK to that person , which they did

    Either the rep for ECP or the judge could well ask you if you were the driver , so your answer is yes , no , or don't know !

    Unless you can categorically state that you were not the driver , it will be assumed that you were the driver

    In the above scenario , POFA is irrelevant , as is the dispute over dates

    ECP will state the 2 working days rule , so it is deemed reasonable to assume that royal mail will deliver the NTK before the new year , meaning the judge will say , next !!! Move along !!!

    As we keep saying , plan A is the best option , it always is , always will be
  • Conflicting advice on here. I used newbies template as well as adding the vehicle had a mechanical failure all turned down by POPLA so I presume I just play the waiting game.Does anyone know what the final cost roughly if you lose in court ?

  • Just received 3rd debt recovery letter this one claiming final notice 30 days to legal action. Can I assume that if I hear nothing after 30 days the case is closed
