Parking Charge Notice

Hi.
I parked my car (on two separate occasions) on a pavement next to a takeaway for less than ten minutes to collect a takeaway. I had asked the takeaway owner where I can park and he told me that I could park at the front of the shop which is what I did. A couple of weeks later I received two PCN’s from Euro Parking Services Ltd in the post. As it was late and due to poor lighting I had not even noticed the signs that were displayed on the wall next to where I had parked. I went back to check and noticed the signs were there but they were not clear and had white marks covering some parts of the signs. Also there were no markings on the pavement to say where the parking restrictions applied to.

I appealed to Euro Parking services explaining that the takeaway owner had told me I could park on the pavement and also that the signs were not clear and there were no clear markings to show where the parking charges applied to. It looked like the charges applied to an area behind a gate and not to where I was parked. A few days ago I received another letter from Euro Parking Services Ltd saying the charge had increased to £100 for each offence. I checked my email and noticed that ai had missed an email from Euro Parking saying that my appeal had been rejected and I could appeal to IAS if I didn’t agree. However it had to be done within 21 days. It had been more than 21 days when I saw the email. I would like to know what my options are? Can I still appeal to the IAS or is it too late? Any help will be greatly appreciated.

I had parked right against the wall in front of the shop with the blue front. You can see the warning signs on either side of the gate where the white van is parked with its back doors open. It looks like the signs apply to the area inside the gate, not the pavement. There is no marking on the pavement to say where the parking charges apply to.0

These were two of the signs that were displayed. They were covered with white patches so you could not read all of the conditions.

Do I have a case and can I still fight it or should I cut my losses and pay the two £100 fines?0

You don't seem to have read any other Euro Parking Services threads, although I appreciate they are hard to search for as their name is so generic. However they are well known for operating very shadily. This is not private land, it's a pavement flanking the public highway, where the road marking on the road apply:

As above , I certainly would not pay because the pavement is council controlled, not EOS controlled
As an aside , nobody should be parking on the pavement and I thought pavement parking was prohibited in London
No shop owner or tenant can authorise pavement parking , but EPS are sc#mmers and sc#mming you
The council could issue a real PCN however , if they caught you doing it , but not EPS , so check with the council that it is their jurisdiction and if so report EPS3 -

OK, it is from 2016, but it does show the different pavement surfaces.
I would suggest that pavement is split such that the six feet or so in front of the properties actually belongs to the adjoining property, and the pavement itself is just the eight to ten feet nearest the kerb.
That can probably be confirmed by looking the other way - https://goo.gl/maps/uMs1MTS67MQz87wU9 - where some shopkeepers have stacked their wares up to the borderline.
I can't quite work out where the OP parked, but if it was on that strip closer to the properties then it does seem to suggest that it was indeed parked on private land.4 -
Interesting information above , I concur that it is a plausible supposition to make judging by the different pavement styles and the stacking of wares up to that demarcation strip. Who would have thought ?? Lol 😄1

KeithP, I was parked where the red car is parked.
The pavement is a different colour as you say but it doesn’t mention anywhere that that is where the private land starts or ends, if indeed it is private land.0 -
I don’t know how how you got the google maps link from 2016 but as you can see the warning signs are now either side of the gate where the van is parked. It seems like they apply to the area where the van is parked and not the pavement.
