Chassis number and v5

  • I have no idea on how to move forward ... they have my car and v5 ..it’s a minor Clerical  mistake on chassis number in the beginning. , it’s a major fault with VOSA regarding them mot mine and her car without physically checking they had the correct car in their mot bay 

    note, both cars were never in for mot on same day , so they have done 3 mots on each car ... 

    Someone is calling me from head office tomorrow..

    Get past the MOT. They had a car with your plate in the bay, they just didn't check the VIN plate, and assumed. Slap wrist. It's irrelevant, anyway, as soon as the next MOT's done.

    They've got your car, yes. And you've got their car while they're figuring out what to do.

    So what do you WANT them to do?
    Do you want them to sort the paperwork out with the other owner, so your V5C matches your car?
    Or do you want them to buy the car off you?
    Because I'm really struggling to see any third option...

    I thought you weren't making any further comment on this thread. 

    The vin was visible they didn't check it's hardly a major.

    I'd argue it is a major oversight.
    But ... what's done is done.  Rosie needs to work out what resolution she wants and press for it.

    You complain you "can't sell it" - yes, you can. Back to the dealer, for a fair market value.
    But it won’t be fair market price , it has no mot or service history now due to their error 
    It's nonsense to claim that it has no MOT or service history. Your physical car has exactly the same MOT and service history as it did before you noticed this. The physical car was serviced as per your previous visits. Whatever VIN number isn't relevant to what was physically done to your car.
    Remember the saying: if it looks too good to be true it almost certainly is.

    my insurance company has advised me to get legal advice as they are not 100 % sure I would have been insured as the mot did not correspond with the vehicle it was assigned to 

    I will not longer reply On this thread  as no one seems to think the dealer has done anything wrong ... I appreciate initially it was human error .. mot a car illegally is not a minor issue ! they will have to deal woth dvsa and VOSA at some point

    Did your insurance company really tell you to go and ask an unconnected third party if you were still insured.?
    My car  was not on the DVSA system although presumably it had a V5 ad was taxed  (Leased)  but my MOT station managed to MOT it
    ( Big clue if you bring a car into this country on foreign plates then you have to have it MOTed from a vin that does not exist on DVLA computer before you can register and tax it.)
    My guess is no court in the country is going to convict you if you produce evidence a main dealer MOTed your car what ever the situation

    How did they mot it is the question?? They have broken VOSA guidelines , 

    no one seems concerned with this ... it’s a serious issue to mot a vehicle thats not been correctly identified... it’s classed as a major not minor with  VOSA 

    I’ll end this now as you all obviously think this is trivial, hope it never happens to you or a family member ! 
    SO REPORT THEM THEN.......

    Will not help you getting your car sorted .But from the sound of it will make you feel better.

    Odds on the software they use picks up the car from the reg plate. So a simple error. Humans are fallible. If you want the issue sorting let the dealer deal with it. You have a car in the meantime & this is the only way to get it sorted.

    While you are waiting think what you would like the dealer to compensate you with... Flowers, basket of fruit.. Or even better FREE servicing & MOT for the rest of the time you have the car, given how much you like it.
