It is an inconvenience, it is a PITA and yes the MOT tester at the dealership has done wrong (and I am sure they will be dealt with by DVSA) but it is not the drama that you are making it out to be. No one has died, no kittens have been injured and your car has been serviced and checked for safety every year. It can and will be corrected and I expect you will be offered some gesture by the dealership as compensation for the inconvenience.

they came and took my car yesterday with the logbook , I have no idea when I am getting it back , I can’t get any answers ... I paid cash for the car so it’s not under pcp or finance ..I own it outright0 -
What is it about then ? You will get the same piece of shiny metal back with the corrected paperwork. In the meantime they have given you another vehicle to drive around in, what more do you want them to do ?

We both can’t ignore the paperwork , we can’t sell the vehicles in the future as it stands , then paperwork and the cars don’t match , so even if we could sell ..service and mot history is void as it is now
You are massively overthinking this.
You have a V5C with the VIN of her car. She has a V5C with the VIN of your car.
The two of you simply swap VINs and plates.
The two of you then get the cars re-tested.
The two of you each get a letter from the dealer explaining the swap. You file that with the service docs predating the swap.
That's it. End of. You have matching car and V5C, and you have service history docs.0 -

my insurance company has advised me to get legal advice as they are not 100 % sure I would have been insured as the mot did not correspond with the vehicle it was assigned to
I will not longer reply On this thread as no one seems to think the dealer has done anything wrong ... I appreciate initially it was human error .. mot a car illegally is not a minor issue ! they will have to deal woth dvsa and VOSA at some pointthank you anyway for ur replies0 -
The MOT tester has definitely failed their duty. If you look at your old certificates, it would be interesting to note if it was the same person each time. I guess they're in for a tough time from both the dealer and from DVLA.
But ... you need to think through what you want the dealer to do now. The minimum is swapping the two number plates over, aligning the service histories and issuing you both a new MOT. With a courtesy car for both of you until you're legal again. I don't know if it's possible to do that without increasing the number of keepers.
You should be thinking about what (if anything) you want more than that. A free service or two? Them to buy the car back at a fair price? Them to replace the car with something equivalent without the troubling history? Having worked in a customer role, if you can't tell the dealer what you want them to do, they'll likely do the minimum.

PS. after a friend found different numbers on the front and rear of his new car, I now check mine (and the VIN) when picking up a new (or new-to-me) car. Mistakes do happen - though I've never known one to not be picked up on the MOT.1 -

That's not what has been said.
Stop focussing on the MOT. It's irrelevant in terms of moving things forward. Yes, the tester dropped one. Yes, their procedures need tightening. Take the car elsewhere for future work.
The question now is how you are going to get this sorted, and move on with life?
Fretting about past MOTs does not get your car and V5C to match, does it?1 -
The car in their bay was not the car on the system , they done no physical checks to ensure had the correct car
