Moving house...seller taking summer house

    well good outcome i believe. get it and carry on with the sale.

    I was reading this thread yesterday and was a little surprised how many pages this has now gone as of today. 

    Sorry if it's been highlighted, I haven't been able to keep up with the back and forth but I'm surprised there is an issue given my quote from the OP's first post. 

    I'm struggling to see the issue. If it's not included in the particulars then you shouldn't expect it to remain. 
    Particulars are very important and the seller and EA must make sure they are honest and accurate. They did, the didn't include the summer house and it isn't staying. 

    What someone may have said in passing is not relevant. If it's not in black and white then it's not binding. 
    I personally would feel very messed about if someone started renegotiating or pulled out because of something not listed for sale in the first place. 
    Might be worth reading the thread to put things into context.

    I'd be very tempted to say something along the lines of: "I'm terribly sorry but all this discussion about the summer house has upset me, and I'm not sure I want to go ahead after all." Just to see what the seller's reaction is. You'll then find out just how far out they are on a limb with having exchanged on their new home already. Or not, as the case may be. Either way, you'll not lose the purchase. 
    No reliance should be placed on the above! Absolutely none, do you hear?

    I think both parties are happy with the outcome, just focus on getting the move sorted. A good relationship with your seller is always advantageous especially when working out completion dates etc.

    Well, the OP has been gazumped £1000. It’s not a fortune, but I’m surprised he/she feels particularly good about it.

    I guess its however you interpret the situation. The summerhouse was never listed or formally agreed as part of the sale nor did the OP confirm this in their offer. They have come to an arrangement which im sure the OP is happy that the sale is going ahead and she is getting the summer house. The valuation price was for the house that didn't include the summerhouse so not gazumped in my opinion.
