100% FACT. I’ve just read through the original appeal and definitely no admissions of who was driving were made. CP Plus just decided upon an answer that suited them. I’ve just emailed our MP about this as well as surely this constitutes a blatant breach of regulations? More so, given that I didn’t, and still do not, nor would I ever give my consent to this.1

But It is final/binding? . I have twice missed a drop down box on Ebay and signed up for Amazon Prime by mistake, (as have thousands of others). It is very close to inertia selling which is illegal

LATEST UPDATE: After the original email to MOTO in relation to the PCN didn’t have the desired effect, and resulted in a rejection from CP Plus, a more reasoned and robust email was sent to the CEO of MOTO last night. Today, we received a response from MOTOs Commercial Manager and happy to say that another victory over a private parking company has been achieved as MOTO have decided to cancel the charge. We just want to say a big thank you to all on this forum who have chipped in with advice and input on how to get these unfair and unjustifiable charges cancelled. Keep up the good work people and hopefully it won’t be too long before the government put a long overdue end to these predatory parasites ripping off motorists. Thanks once again for all your help. It was very much appreciated.6

Absolutely! The original complaint was probably too nice. The one sent last night had a much angrier tone without being nasty or abusive and it clearly worked.2

I do wonder what MOTO are making of it all, after years of using a benign PPC who has now decided to get litigious, due to the lack of money coming in.

I sent another email to MOTO basically thanking them for finally reaching the sensible and correct decision. I also pointed out to them that MOTO run the risk of chasing customers away while these reptiles are dishing out PCNs like post-it notes, especially when MOTO themselves aren’t incurring any losses.3
