Following on from everyone’s advice, I’ve decided to send a consent order back, discounting the £90, ordering that I pay the invoice after the order has been sealed and ordering that the set aside is under CPR 13.2 as I believe no steps were taken to to find my correct address. I shall await there response.0

Fighting scammers is not a waste of time. Paying scammers is a denial of justice. Why on earth should this be stressful,? With our help this is a walk in the park. You never know how far you can go until you go too far.0

I wouldn't actually pay the ccj amount until after the court sets aside.
It also doesn't matter which rule is used to set aside as all you want is removal.2 -
Sort of related.. I've got a court date in May for my parking ticket from Napier / BW Legal. I've just realised that Napier have conducted a soft search on my credit file several months ago. Are they allowed to do this? And why?!0

Yes theyre allowed to, and likely to Trace your current address2

I'd have thought they'd contact the DVLA/DSA for that? Credit record does seem very (very) dodgy0

2) No it isnt dodgy and is exactly what theyre supposed to do to confirm the address for servuce IF they have (or should have) doubts as to whether it is a true last known address or not.3 -
DCB Legal emailed me today to state they conducted an Experian trace on 3rd September 2020 which confirmed my address of where they sent the court letters to. However I have spoken with the electoral register and they have stated that I was on the electoral register from 3rd August 2020 at a different address. How can it be possible what DCB are saying?1
