At the very least you should challenge the Enforcement costs.You never know how far you can go until you go too far.1 -
I also suggest that it would be madness to pay over £400 when you are likely to pay zero.
If you didn't get the claim form and they sent it to an old address then that's a mandatory set aside situation (CCJ wiped) and often a Judge will even order them to pay the £255 back to you. And usually, the PPCs then discontinue and don't pursue it further and you never even have to 'argue to defend the PCN claim'.
This is all explained in the NEWBIES thread and just takes £255 as a court fee up front, and copying from the 2 examples of set asides shown there.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

DCBL: has added even more money on, for "compliance" (£90 has nothing to do with a warrant of cointrol, its pure profit) and so the amount is a scam
While you are likely to win on CPR13.3 grounds, youre signing away a g'teed set aside (assuming you get a judge who understands the law of course) under CPR13.2 for a discretio9nary ground.
The order is really clear, it states Judgment is set aside.2 -
Thankyou for all of your help as I really wouldn't of had a clue where to even start without this forum and I wouldn't have even known CCJ's could be disputed in the first place. I know you all won't agree, however I am just going to pay the money and sign the consent order (given in too easy I know). I just do not have the time to be writing witness statements and attending hearings and I can't be bothered with the hassle of it all. This is for sure a MASSIVE lesson learnt to keep my addresses up to date fully and NOT park in staff bays. Thankyou for all of your help and fingers crossed the judge agrees to seal the set aside with consent.0

do not pay until you have had conformation as to the correct proceedure ...the scammers do not care and could easily take the money and leave you with the CCJ .... please don't think this does not happen .. it does.We all think you should still fight this...you do know that you would not be going to a bricks and mortar court ??? it would the a telephone zoom type meeting 30 - 60 mins.Ralph1

Do you mean do not pay until they confirm to sign the consent order? I told them I would rather send off the application to the courts and pay the courts the £100 but they refused stating it is not possible.0
