    A)  that something was not as described, NEW when in fact 14 years old.
But they were new - they were unused and still had the original label on.
Goods can sit on a shelf for any period of time and still be regarded as new. Almost everything beyond fresh food will potentially have been manufactured years before sale.

The tyre industry regards tyres over 5yo as no longer new, whether used or not - but that's not legally binding.

Some can, some can't.  Pharmaceuticals are just one example but there are many more.

Both are true; some stuff has an expiry date.
Tyre age restrictions only apply to front axles of passenger vehicles.

I think there needs to be some expecations from the listing; the seller is selling a pretty random selection of single/pairs of tyres with photos taken in 2019 of oldish looking tyres randomly thrown around the ground. He's also implying that he's not a tyre seller since he won't deliver or wait for couriers. The sellers other listing look like he's running a scrap yard, so I'd be expecting scrap yard tyres (something that'll get you through a trade-in).

You'd be hard pushed to convince anyone you thought these tyres were top quality fresh from the factory.

Yes he has got the message he should not have sold old stock as new... what's your point?
    Caveat emptor.
I could only find these exact tyres new in Europe
No great surprise - Nokian are a very niche manufacturer in the UK. I've only ever seen their winters for sale through reputable channels here.
What was it that meant you particularly wanted to search these particular tyres out? It's certainly not a brand renowned for their summer tyres... They are Finnish, after all. And their range is very limited.

Even then, Nokian's own website lists just 25 "authorised dealers" in the UK, eight of whom are outlets for one small regional chain around Lincolnshire.
The Nokian winters I had were supplied from the continent, via probably the largest mainstream online tyre supplier in Europe, Oponeo.
I paid virtually the retail price for these tyres, so again you are wrong
You said they were "nearly £100" for the pair, and they were for a BMW, but you don't appear to have ever stated what size they were. Would you be so kind?

His other listings show he's breaking cars.

There's a press release from Nokian mentioning a winter tyre (WR D4 in the size 225/55 R17 97H) being the OEM fit for the BMW X1: https://www.nokiantyres.com/company/news-article/nokian-tyres-strengthens-its-cooperation-with-car-manufacturers-in-central-europe/

Which are £157.99 each on mytires.co.uk

But we know these aren't winter tyres.

True, though that's the only reference I found to them being OEM on BMW which is presumably the only reason the OP is set on having them over the dozens of better choices.

    SUMMARY
Unlike some very sad people who like to troll on these forums I posted to warn people about dodgy sellers and the importance of really checking the DOT date on tyres. Due to circumstances  I was caught out and have a lot more experience on eBay than most and a lot more motor trade experience than most.
I posted because 'new' tyres were bought for car I was selling (my own BMW), no one I know in the motor trade has ever seen just how dangerous old stock tyres can be in just a few months and under 500 miles, we suspect apart from fact they were old stock it was how they had been stored.
If my posting has helped someone avoid buying old/new tyres then putting up with !!!!!! heads who enjoy trolling forums has been worth it... take care and stay safe.  o:)
Could you therefore help future buyers out by advising where the DOT code is and the format on this specific brand of tyre if they are so hard to find. You’d be helping a lot of people.
Absolutely. If you're giving a warning it's a bit daft to not actually give the info that would help people
Remember the saying: if it looks too good to be true it almost certainly is.
