providing the attendant is up to speed with all the latest health and safety guidelines, the fire brigade should of been called and the forecourt closed untill given the all clear by the fire brigade.0 -

Due to Covid the garage were not allowing you to fill the car yourself, they were filling it for you whist you stayed in the car.
When asked what fuel he wanted my son accidently pointed towards the diesel pump, and the garage employee proceeded to fill his car with diesel.
Obviously my son did not get far from the filling station before his car packed up completely.
This resulted in him having to be recovered to get home and paying out to have the car drained and put right.
As he payed cash he did not have an electronic record of having filled at the garage, but he has requested video surveillance from the garage to confirm he filled up there.
I am wondering though if the garage is responsible and liable for what happened.
He has owned the car for 2 years and has always put petrol in, so if he had filled the car himself as normal, that is what he would have done.
Also the facts of the sticker on the fuel cap stating petrol, and the diesel spout not fitting into his fuel pipe would have been a bit of a dead give away.
Surely this should have been noticed by the garage employee.
The guys who fixed his car said that the employee would not have been able to get the diesel spout in so they must have just held it against the pipe.
By not allowing him to fill the car himself would the garage have taken over responsibility for the above happening?
If anyone can help or advise I would be very grateful.
I will ignore the fact that your son has 2 years experience of using the correct colour pump but has accidently pointed to the wrong colour.
.The petrol station well deserve to be sued and if it were me I would be issuing an LBA today
They have breached a fundamental duty of care to your son by seemingly not asking him if his car is petrol or diesel and ignoring the sticker and the petrol sticker and the too small hole and the black colouring
The attendant is however a miracle worker who can fill a tank but stop diesel leaking all over the forecourt by holding a pipe against a hole
The attendant is clearly an imbecele
The garage owner is clearly an imbecele for not allowing customers to fill up on their own where every else does allow it and then employing a fool to do it. He created a solution to a problem that did not exist.
As a matter of amusement in Oregon USA almost all petrol delivery is mandated to be attendant filled
However across the road when we experienced I was amused to see a shop with a huge Cannabis leaf outside

Also I do not know wether or not the attendant could be seen filling up from the drivers side as I do not know what side his petrol cap is on.
On my bmax it's on the passenger side so I would not have noticed.
I also know from being young and sometimes peed off at work, that the attendant might have noticed the mistake but still done it.0 -
What car is it ?As many have said what happened is just about impossible on any car made this century unless it was actually diesel coming through the petrol pump.3

Maybe your son is lying about what happened to cover his embarrassment? All sounds rather odd.0
