Help regarding car I bought on finance, that’s modified.
Options
Hi there! I recently purchased a financed car from a dealership( around 4 weeks ago) during the hand over process, he handed me a ‘DPF delete waiver’ (diesel car).
now he went on to tell me that, that the only reason I’d need to sign this is because he recently had a customer, that found out their car had the DPF removed, and rightly so, had the garage pay to fit one back in.
To myself and most people, I didn’t think anything of it, and signed away, not thinking I was possibly this ‘customer’ and he was making a story up..
my car has recently been in for some work, the mechanics done a general inspection, a general health check.
upon looking into it, they have found that the car indeed does not have a DPF, so going off his story, I am that ‘recent’ customer.
where do I stand with this? My car was clearly modified prior to sale and he must of knew to give me that story, I’ve looked further into it at my local dealership and they also see a code stored in the ecu, to show it has had ecu tuning.
am I right in saying this car is missold? I’ve been told it would not pass its next mot due to the DPF being deleted.
Any help would be massively appreciated.

You're on a parking forum here. Maybe try the quite separate 'Motoring' forum. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So you signed a waiver saying the DPF was removed or a waiver that said the DPF was removed but replaced? Your point on that isn't clear. Your advice depends on what the waiver actually says regarding this.1

he used a ‘story’ to cover up the fact that it was probably the car I was purchasing, being given a general story I didn’t think it would be an issue, so i signed it.. reason behind me signing was it had an mot the day I picked it up (my understanding is, if it had an mot hours before I picked it up, then the DPF was obviously in tact and there)
when in actual fact, when I’ve had it checked over, it isn’t there, it’s been removed and welded back in place, and the ecu also tuned.
im now told my car is not legal for the road, and my insurance is also void due to it not being road worthy.0 -
So this is the ‘waiver’ obviously I cannot inspect a car on the floor, to see whether it had a DPF or not.
this ‘should’ of flagged up in the mot it had 6 hours prior to me taking ownership, IF the mot was a legit one I guess..they say returns are not accepted, but my understanding is, this car has been missold, and not roadworthy, and a dodgy mot.0 -
