Start a new thread on the parking eye one and let this one continue as the NOE one due to the pictures

You should have started one thread for each topic , one for NPE , one for PE

It's one topic , one thread on here

As for the NPE one , it's not about being at LBC stage , it's about finding all the info about the sc@m and preparing

As for any LBC stage , the advice for LBC is in the Newbies FAQ sticky thread and does not change apart from PE where you follow the advice from coupon mad about resetting to Popla or negotiating a settlement which you have already been told

I think put the NPE one on a new thread when you get a claim.

You DON'T need assistance at LBC stage because it's done to death in the NEWBIES thread and in every single other exact same (regardless of PPC) BW Legal LBC thread you read.  Spare us, till court claim stage.  You will get a claim so no panicking.

Yeah, I meant assistance when it gets to claim stage of that one, thanks, I am OK with that one going to claim stage and defending it as it is absolutely ludicrous. The PE one, I think is unfair given the circumstances, I see another thread about negotiation, would it be fair to offer less than the 60 if I show my workings out? e.g. overstay time x 4 + admin + dvla fee + additional, if I do that is it likely that they will say NO to all negotiation thereafter?

That's my last Q on the PE one, I will start a new thread if needed if we receive a package from Northampton, I know the deadline was a week ago so I am expecting this but I did email them last night and will see what they come back with.

Start where you like , like maybe £20 as shown for major keying errors in the BPA CoP

It may be unfair , but unfairness has no legal standing in this unregulated industry

If you do start a new thread on either of them , add a link to this thread for background information and pictures etc

Nobody from PE comes here to comment so we do not know what their reply will be

PE won't be interested in your calculations. Offer them a round figure and see how they respond. Don't over-complicate things. That's about it.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Hi - after a massive delay we have got a letter back from PE with a POPLA code and a offer of discounted rate, they state if appeal is unsuccessful then the discounted rate is full rate again.

Was the general advise here to pay the discounted rate or should I refresh via this thread and the newbies thread and make a POPLA appeal?

BW Legal have stopped sending texts, mail and phone calls for the moment so the PE one is the most important I would say, happy however that I was able to get back to this stage from the LBCC due to my partner ignoring the letters

I would submit a POPLA appeal.  At the moment POPLA are only accepting/allowing outline appeals and expecting them to be expanded upon when POPLA are back in full swing - whenever that might be.
Covid-19 update: We will be adjourning consideration of appeals for a short period due to national restrictions. If you want to appeal, you must register your appeal now as best you can, but you will be given extra time to submit additional information later. Full details on our FAQ pages.
Info above from POPLA web site.

Due to these facts about a long overstay, unless the landowner will cancel it when she complains (should have done that already?) then maybe this one is better paid at the discount - and I rarely say that:
The landowner for the car park in this case I cannot identify, there is no clear signage anywhere, the overstay was 2 hours around 50 minutes, she paid for 3 hours and due to the time social distancing and other various wait times meant her appointment lasted longer than the 3 hours she planned for.
She knew she had overstayed but the place of appointment did not accept cash and therefore was unable to provide any change for her to at least buy another ticket to show willing.

I presume I cant make my own offer to them (PE)? I guess this one will have to be paid....
