    Not enough info to know

What you don't want is a PE Court claim pack from the CCBC in Northampton to arrive

I would be emailing them if you have the PCN reference with an offer without prejudice , starting at £60 , as an email to enforcement at parking eye , it's an email something like that , coupon mad has posted it numerous times previously in Parking Eye threads, do some searching

The npe co-op one is a well known predatory sc@m , so search for the details
Info on what one? NPE one I have been looking, and I see lots of people post asking for help, always laughed at them but now I am one so I feel bad lol. I am unsure on the exact terms to be searching... I've read a lot of the BWLegal threads.

I'll have a look for coupon mad's post.

It won't cost Parking Eye money as such.  , They issue in house and do their own litigation , so are already paid

The court fees and legal costs are £75 , added to their £100 claim , making the amount you pay within a month after losing
Okay... so are you advising I just pay it now as its more than likely that we will loose because her head was buried in the sand on this one!! I just checked the SAR request response these are key points which will hopefully provide the blood from the stone:
    • First letter was Parking Charge Notice, no notice to keeper
    • Date of event: 27th July 2020, Date issued 30th July 2020
    • Appeal sent via website, 4th August 2020
    • Appeal rejected via email 18th August 2020 with POPLA details, this was not actioned 'head in sand' it seems.
    • LBCCC 17th November 2020
I don't get why you are not simply following the clear info about Parking Eye LBCCC stage, in the NEWBIES thread, to get a new POPLA code. They will probably even re-offer £60 as well as giving a POPLA code.  The NEWBIES thread says all this.

Not sure why I write the stuff in the NEWBIES when I see threads 5 pages long going all round the houses, panicking about having to pay or face court, and not doing the email recommended to get a POPLA code re-issued, which P/Eye do.

The email for negotiating with PE is 'enforcement@ ......'
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

As the NEWBIES thread tells everyone already in the section specially about ParkingEye LBCCC stage, to prevent 5 page threads about it.

This NPE and co-op saga smacks of previous threads we have seen on here and I think the co-op kicked them out due to a similar sc#m , possibly at this location , or a similar location

Look for similar issues with npe threads and co-op threads , or joint threads with both mentioned

You are not the first with this particular sc@m on here , we have seen it before , it may have been in the papers otpr on TV too

    Perhaps in Parking Wars ?
I take on board your advise on PE re negotiation, I did a quick search and couldn't see directly how I would initiate this, do I wait for the next letter or should I be contacting them now?
Not enough info on if PE are ready to issue the court claim , because you ask about the next letter

I am saying that you do not want their next letter to be a court claim from the CCBC in Northampton !!!

Coupon mad makes a very valid point about the info on trying for a new popla code and the PE lbccc stage from the newbies FAQ sticky thread , I thought you were past that and almost at court claim stage !

You say you cannot see it , yet she has already dedicated a section to it !

Earlier in this thread you stated you have read it and been following that newbies thread

@Coupon-mad I just opened the thread up and searched for POPLA and read everything and I must be absolutely stone cold blind? This section: ALWAYS look at the wording of any PCN from ParkingEye to see if it is a 'POFA/keeper liability after 29 days' one or not. There are two versions - look on the BACK of your PCN!

FWIW the back of it has nothing about POFA at all, and in the SAR request when I search POFA the only thing that comes up is in the LBCCC which says 6. As court proceedings have not yet begun and as no defence has yet been filed, it is impossible for ParkingEye to state exactly the documents that will be relied upon. However, the essential documents will be; all Parking Charge notices that have been sent, any defence submitted by you, any reply to defence submitted by us, any document proving ParkingEye’s authorisation to operate on site, and any signage plan or images of signage from the site in question. Documentation could also include the POFA 2012 and the BPA Code of Practice.

I am deeply sorry........... I have just Control + F searched that whole thread for LBCC, ParkingEye POFA & POPFA... I really hate being one of those newbies!!!!

OK I see, its not that black and white and it is implied that you can go back to appeals stage by emailing them... I will do that... thank you....

So you found it then, because LBCCC finds it.  I just re-checked.

Well the earlier timescales you posted comply with POFA timescales , so if that letter is the first NTK and not the second letter reminder , it should have the POFA warning on it , or it fails POFA

The second letter reminder will not have that warning on it because it is not the NTK PCN , it's a reminder

The devil is in the detail

Apologies, its the terminology, and the panic! I really appreciate it all.

The SAR request they sent me contains all the letters they sent, the only letter in the request is the PCN, there was no notice to keeper and the only mention of POFA using Control + F to find is in the LBCCC.

Should I be saying anything in particular to enforcement? I note about it not being received and maybe being in the spam folder, can I literally ask that with a friendly fairness tone to the email?
