...in fact they have images for 6 months of car parking on site but only supplied images of incident date  as explained driver is employed on site.
Are you sure they have those images?
Keep in mind that they may well have had those images once upon a time, but having decided that the driver broke no rules on many occasions, they could, quite reasonably, discard those images very soon after the parking event.

Or to put it another way... if they were to keep those images for no particular reason, that in itself would be a breach of the Data Protection Act.

    le_kirk  Thanks for the reply,
When you start work on site the company registers vehicle details with ppc to allow you to park as we did and vehicle details were changed when original car was sold  and this one bought & when had to hire a car

    Kiethp,
I agree so may be best to leave it at the moment as we now have the prove the driver was at work on the day and due to times on clocking card could not have left the car park as they state so wondering who there agent saw and how did he see car parked at 13.44 when in fact it was parked at 0950

I would still be replying to the DPO at Care parking stating what was said overleaf and referring them to that data protection section, if they have any data on that date of the vehicle leaving and returning they should have disclosed it, which they did not

this is not a new SAR, its a reply to the original SAR reply detailing what they omitted and putting them on the spot with the threat of an ICO complaint

Then, for your witness statement, you need a signed letter from the company explaining exactly that.

    Hi all,
Today my wife the registerd keeper and driver at the time received a LBC from those nice people at CST Law.
I can do the AOS on her behalf but can i sign as pp at the moment my wife is seriously ill in hospital in Ukraine and will not be returning for at least two - three months if not longer.

I'm not sure anyone here can offer a legal opinion on that. Perhaps this is a situation where it may be best to call the CCBC and ask for advice? (Make sure to follow that up with an email to confirm the advice given, or ask them to confirm by email).

You do not need legal advice, you need a search engine, read this

You never know how far you can go until you go too far.

This is a court claim, sir, not a LBC or anything like that. AFAIK it is the named defendant* who must sign the AoS and defence.

    * Unless the OP has gained Power of Attorney on behalf of their wife).

Do you mean a LBC (which is what you said)?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
