        Driver has stated was at work all day and never left the car park so will be interesting to see who left at that time

    Hi All,
      I complained to bpa,mp,and Preston council,also sent the below to care parking as we want the images or car and drive as stated above the driver was at work that day and care parking have car reg on system to enable shop employees to park.
       First that is not our email address
               In relation to the reasons of why you issued the pcn that you did not give originally.
       customer only car park.
        i draw your attention to planning application granted for the site section 6.1 item 2 i have taken this up with Preston council not upholding planning rights.
     The operative witnessed drive exit vehicle and leave site,
        Please provide evidence of this and the car entering the car park and time of entry and exit.
     Driver not present when ticket was issued.
      There is evidence the driver was on site at the time in fact for several hours there for was a patron of the site, see above re evidence of leaving site.
     They replied not going into multiple appeals, Basically wrote back stating we are not entering multiple appeals just want the images of car showing times of entry and exit and driver leaving car park, if i ask for a sar would they have to include the imiges if we requested them. Thanks in advance

    Yes the parking firm would, if they have them.  They won't have any!  Email a SAR to the PPC.

    Hi All
     Hope you are all well,
     We received the sar back from care parking but only had images of car parked and statement of officer observing driver parking and leaving car park no images of car entering or leaving car park despite having anpr cameras also no document that care parking have that aloes car to park can we request another sar to get this information.
      Also today received clocking details of driver for the day pcn was issued shows driver clocked on at 09.56 clocek out for dinner at 12.01 returned from dinner at 12.32 remained in shop for dinner clocked out from work at 16.01 so how does care parking attendant say he saw driver leave car park at 13.44?. Is it now best to wait for court or send doc to ppc sorry not up to date with civil courts.
      We also complained to BPA but they were not interested just kept on about members must adhere to code of conduct.

    I think you have gone as far as you can with the scammers and the BPA. 
    Does the original planning application, or any amendments to it allow car park users to leave the site (usually to support other local businesses), and what was the original parking time allowed by the council.
    This wouldn't be the first time a parking scammer has arbitrarily reduced the permitted parking time to less than was originally granted when planning permission was approved.
    Also, have you checked to see if the ANPR scameras have planning permission, and have the scammers obtained advertising consent for the signs? Not having the latter is a criminal offence, but only the council can pursue it. Sadly, very few do.

    According to your post of 15th February the vehicle is already registered with Care Parking; so have they provided evidence of this in the SAR reply.

    As for the "driver" leaving the car park at 13.44 I'm guessing they haven't sent any photos?

               The original planning application was for 2hrs 30 for parking for people on or off site to help reduce congestion in town center later reduced to 1 hr 30 by ppc who managed site before care parking (planning num 06/1995/0012 by dutton foreshaw) this was brought to the attention of care parking who said it was not applicable also sinage says 2 hours free parking but must remain on site att all times.

    Then they haven't complied with the original SAR; so there's no need for "another" SAR.

    Refer their DPO to Section 173 of the DPA 2018 which makes it an offence to "alter, deface, block, erase, destroy or conceal information with the intention of preventing disclosure of all or part of the information that the person making the request would have been entitled to receive".
