Yes, ask Travelodge asap. I think they are legally obliged to keep their records for 6 years so they will still have it on their system. I am not sure if they are legally obliged to provide the receipt to you but I don't see any reason why a half decent company would object. If you don't ask you won't know.
Also completely agree with blackdog that Moto/Roadchef must be getting very annoyed with all this hassle from disgruntled customers so when you get the receipt write to the MD as per the post above.2 -
They will have to keep a copy of the VAT invoice for 6 years; which would confirm the customer's name and the dates of the stay.woodpecker44 said:Yes, ask Travelodge asap. Hi All,An update on this, travelodge are going to request cancellation of the PCN, which should then generate a letter and they are checking if that goes to me or CP plus/dcbl. However due to covid etc they've said their parking department can take longer than normal to process it. Whilst this is good news I am almost out of time and must file a defence by the 8th March (claim date was 1st Feb and I did AOS on the 8th). Assuming I don't get anything concrete in the next few days, would I file the template defence provided here and customise the top part stating I was staying at the hotel and travelodge are in the process of cancelling it? Would that be acceptable to a judge or do they expect all paperwork to be obtained upon filing the defence? (I should certainly have the evidence and confirmation by the time any hearing occurs)Thanks0

You know that no evidence is sent alongside a defence The newbies thread is clear when evidence is sent!
do not , under any circumstances , miss the courts deadline.2 -
Would that be acceptable to a judge or do they expect all paperwork to be obtained upon filing the defenceNo one here second guesses a Judge. I don't know exactly how many thousands of them there are across the country, but you really are asking totally impossible questions. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Rule of thumb , get it done !!!
Regardless , assume it will be a cranky judge , assume it will go ahead , assume your worst fears , until the contrary happens
The claimant has a few weeks to consider your defence , then tells the CCBC if they are going head or not
If you fail to follow the process , A default CCJ will ensue , not a good thing !! So get on with it until the juggernaut stops
If it ever gets in front of a judge , it will be in several months time !!1 -
Thanks for the replies. If I hear nothing back tomorrow I will file the defence. If I've understood correctly then, in this instance I will take the template defence, keep everything as it is but change section 3 and simply state "I was staying at the Travelodge hotel at the time"?

Why on earth would you not also add the obvious updated information about your cancellation promise, to your defence?pmorphy said:Thanks for the replies.
