Send an email to the DPO of the PPC telling them NOT to use the old address and to erase it immediately and to tell their agents and legal firm.

It's DCB Legal (solicitors), not DCB Limited (debt collectors).
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks Coupon-mad, I did that and both the PPC and dcbl have confirmed they've updated their records. They have ignored/not acknowledged my request for the 30 day hold on the same emails, and the initial request was nearly a month ago. I've also asked them to confirm if any further correspondence was sent to my old address after my intial email letting them know. Since they are not confirming i'm guessing they may have already sent claim forms to the old address. If that is the case and I end up getting a CCJ by default, will I be able to submit a defence/set aside with the full email trail showing they've ignored me? Has this ever happened before?

ok , after reading post , please fill blanks in

letter from dcbl giving 30 days , what date was on the letter heading
you emailed dcbl and ppc to advise of new address , what date was this

I did that and both the PPC and dcbl have confirmed they've updated their records. " what date was this ?

  • dcbl letter giving 30 days was on the 12th October
I emailed PPC my new address on 20th October
I emailed dcbl my new address and requested case be put on hold on 28th October
due to no response I emailed PPC again on 9th November to confirm they updated my address and informed their agent, which they confirmed
then on 19th November I finally received an email from dcbl saying they've updated my address, but no mention about the case being on hold from the 28th October, or confirmation they haven't sent any letters/claims to my old address since the original on 12th October.

So you can see, if they haven't put my case on hold as requested, and have automatically issued claim forms to my old address following original letter expiry on 12th November, resulting in me being unable to defend the claim and getting a default. Will electronic/printed email trails be a valid defence?

    Yes, perfectly acceptable.
  • ok, thanks. I should add I have sent plenty of chase emails to all their email addresses (including another today). So they must be ignoring me and maybe trying for a claim at the old address. I'll see if they come back to me and worst case if not keep an eye out for any CCJs suddently appearing on my report

You are right to be wary, but of course another possibility is that they haven't actually got around to filing a Claim yet.

yes possibly, just think it a little strange that when they finally came back to me, they only mention the address (and referred to the date of my last chase email, not the original), and ignored my clear request for 'on hold' confirmation.
I just worry a lot of this stuff is automated, so if they haven't put me on hold on their computer, it automatically issues the claim form as soon as the LBC expires. Especially since that would of happened before they finally acknowledged by address change.
...side question, if they have issued the claim form to the old address before updating their records to my new address, do they have to re-issue the claim forms and reset the clock on that or?
