  • I suffered the same problem but did a chargeback on the card and received the money back in my account, I suggest everyone does this! Under the consumer credit act of 1973 the merchant and the the merchant acquirer have a joint duty to supply the goods.

For the consumer credit act to be relevant in your case, you must have done a "section 75" claim and not a chargeback as it is S75 of that legislation that makes the credit provider jointly liable with the retailer.

I have started the chargeback process with Tesco Bank and their timeline to respond is 10-12 weeks :) ... Will post the update as soon as I hear something.
I was too with Tesco bank Credit Card and got it back in 3 days after emailing the form to them. They do state 6 weeks, but was credited in 3 days.
Do not forget that while you get a refund once the chargeback is started. The retailer has 45 days to contest, often extended by bank due to the time taken to pick up any rejections.

TBH, Credit/Debit should make no difference as they should be done by the same teams.
So the latest update is that they disputed the chargeback by saying that I did not attempt to resolve the issue with them directly and hence they were not given a chance! How clever and thought after as the moment they took the website down, the IP address and domain were no longer valid and hence anyone trying to get in touch will have their emails undelivered. Luckily I took the screenshot where they had said they will NOT dispute the chargeback and also emails wheere I had asked the order to be cancelled and refunded which they did not. Have submitted it back to Tesco Bank..awaiting their response.
Anyone else have had the same dispute?

I thought you got the credit within 3 days as you mentioned earlier on this thread?

Yes, but it came with a disclaimer that the retailer has 45 days to dispute the chargeback and if they do, bank will be back in touch. So they disputed in about 35 days and so the bank asked for all evidence..they have not yet debited it again while they process my chargeback claim.

Now, the website is offline. And he's still on Trustpilot removing reviews.

Sigh. Hope those who ordered that they learned a lesson.
Hey, sadly I'm also an idiot and fell for this. Didn't manage to capture that screenshot. Link doesn't work anymore. Any chance you could repost please?
    Cheers!
