Dispute with neighbour - they want to attach their garage extension to our detached garage??

    Or if you google "party wall disputes" you might come up with a firm giving free initial advice?
    If the OP's parent's garage isn't over the boundary - ie. a party wall, then it isn't a matter for a party wall surveyor because it doesn't come under the act.  It's blatant trespass attaching to a neighbouring property and needs legal advice.  

    I wonder if the planning drawings are somewhat clearer than the Land Registry.  It looks to me like the house and garage walls are offset, as someone's already said, to ensure that the roof details don't trespass over neighbouring property.   They're not intended to be party walls.  

    Reading these forums got me paying the extra insurance premiums for legal cover some time ago!

  • There was a fence there until about a month ago, so the wall has also been attached to the garage.  I think my parents do have some legal cover through their insurance.  I just want him to stop while we agree what is happening as it is causing my parents lots of stress :-(

    They have taken it upon themselves to start attaching their extension to the side of my parents detached garage, without consent.  Are they allowed to do this?

    It seems to me a clear case of trespass.

    In your parents' position, I would be instructing a solicitor. 

  • We cannot get any more detailed information from planning or the housebuilder with specific detail on the boundary which is not helping, it's his word against ours but it just doesn't make sense how he could be allowed to attach his property to theirs.  Do you think this is therefore not a case for a party wall agreement? Thanks in advance again.  Never used this forum before, really useful!!

    The fence was obviously marking the boundary if it was there since they were newly built.  It's not word against word.  The neighbours removed it.  

    Are there any photos of the fence?  The Google  Earth is also a bit more detailed than the satellite view on Google Maps.  It can show better angles.

    Is that new wall actually tied in to your parent's garage brickwork, or is it just leaning on it? If the latter, you don't need an injunction...just a sledgehammer...

  • Found a pic on google earth so thank you for that.  The wall has also been attached to my parents garage.
