yes it was posted 26 days after so it was 13 days late ticket issued 23/03 ntk sent 26/04

A weird judge who clearly understood abuse of process ... the fake amount, but did not understand POFA ?
There are judges who need re-training from 2012 onwards.

End of the day, the legal and PPC lost money....... these legals will work for peanuts

A good offer because it would be persuasive if the OP won the appeal based on a POFA ruling

If horizon cannot comply with POFA after over 8 years , they deserve to lose on a non compliance issue

Sounds good but I have no time to offer to assist with this myself so his assistance will have to be a forum effort.

also you were right about gladstones saying that they never recieved my witness statement by email or post ,but the judge read out that i notified the court that i sent both email and postal to gladstones and never asked me for proof.
also the judge was concerned about  why the 2 witness were not present who made the ws and why they never notified the court they they would not be attending i cant remember why he allowed it

just to add that the judge said although he believes i was not the driver and he agreed that gladstones complied with pofa the photograph proof of the said vechile on a grided box with double yellow lines shows clearly that one of my 3 employees parked on the said day and i am liable as the reg keeper.so on that basis was his findings

I'm presuming that you are referring to Schedule 4 PoFA 2012.

As far as I know*, para 8 concerns the postal notice receive a month or so after a 'windscreen ticket' (Notice to Driver) was affixed to the vehicle/handed to the driver at the time of the parking event.

Para 9 concerns cases where there was no NtD, the first Notice to Keeper being sent via post..

These have differing  timescales.
