DEMAND FOR PAYEMENT

That's something you would mention in a defence, but not the defence (that's as per the template defence thread).
And it's not a 'CCJ action'. When people follow our advice there is never a CCJ.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ive sent off the SAR today and emailed the solicitors to put the action on hold.
So now l wait l presume for the data they have to be sent to me to see where l am on this

I have now recieved the data back for my SAR. It isnt including the solicitors letter before action or the data regarding the payment machine etc.
The images of the keepers vehicle show obviously front and rear but even trying to enlarge them l cannot identify the driver. I did ask if it was a video shot for them to send the video which they havnt done if they have one.
So now l have it seems not all the info what do l do now as lm in limbo waiting for what to happen next or what to do next please.

Have you received a claim form (N1) from Northampton CCBC? If not, you are in exactly the same position as you were before you received the results of your SAR. Did they at least send the original PCN so you can see what the problem was - e.g. failing to pay/display, overstaying, no permit etc?3
-
Thankyou for your responce. yes they have sent the first PCN which l didnt receive at all. It stated a faliour to pay pay was the reason for the PARKING CHARGE NOTICE.
I dont know what they will do next. Either drop it which l doubt due to the letter from their solicitor letter before action.
That being said that letter isnt in the SAR or the data from their payment machine.

PS no forms.from cc etc yet.
How do make sure that l know what is going on regards cc etc.because l dont want to suddenly get a judgement in my absense against me without defending it etc.0 -
You won't get a judgment (CCJ) against you unless and until you have received a letter before/of claim, followed by an official N1 claim form, submitted defence and witness statement, gone to court and lost and then failed to pay in the timescale set by the judge. To ensure that you receive all paperwork, make sure that the PPC knows your "address for service" especially if you move. If your present address, the address on your V5C and the address on any paperwork you have received from the PPC or their solicitors is all the same you should be fine.4

Your SAR to Minster Baywatch will only obtain the data they hold , not the solicitors letter because that data controller is the solicitor themselves , different companies , different data controllers
You can reply to Minster to ask for the PDT data regarding your vehicle only , which they may or may not have
Check the NTK PCN and the signage for the correct amount allegedly owed , which is probably £100, the daily default tariff which is common across the industry3 -
Thankyou for your help.
Thankyou Le_kirk for the explaination regarding the county court process.
Thankyou Redx for the info regarding what they have regarding data.
Regarding the signage Redx l cant see any signage in what they sent me or am l not understanding you correctly.
My defence will be l have ni recolection of being there or actually what l was doing on that date. I do not know who the driver could be as.several people have access to my car and the data they have sent and the PCN do not identify the driver. Also l did not receive the first letter informing me of this PCN.and the second came 6 weeks later so l had no oportunity to pay that EVEN IF l was the driver which l cannot say l was anyway.
Would that be worth putting up as a viable defence etc.

You know from the template defence sticky thread, how to do a defence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
