DEMAND FOR PAYEMENT

Ive had a demand for a PCN from Minster baywatch dated 31st July 2020. Its states they recently wrote to me regarding payment and that despite their attemps l havnt responded.  They say they offered a lower initial payment of £60 if not paid in 14 days £100 which was valid for another 14 days.
As this has passed they have handed it over to their INTERNAL collection team now with an additional £55 added now totaling £155 . If l dont pay it by 18th sept they will not be able to prevent further action.
 This DEMAND is the first letter lve had from them. Its been over 6 weeks since the date they say the infringement to.place.
 I honestly cant remember where l was on that date. There are several people who have access to the car.
There is 2 photos of front and rear of the car and the reg can be seen but l cannot see who is in the car by the photo. At this point l have no idea who was driving due to the long time frame and my memory isnt the best nowadays.
I believe the letter was here about the 9th september but l opened it the next day to find this.
 I emailed them basically stating the above and said l declined to give ANY possible names and l cannot remember where l was either. Also the letter was very threatening and l wouldnt enter into anymore correspondence with them untill they addressed the points l made about the alleged incident. 
Have l done right and any more practical knowledge would be appreciated.

    I would have appealed using the blue text template from the NEWBIES thread, regardless of the time lag

    but plan A is a landowner complaint , that is your ideal solution, it always is

    MB may issue a court claim against you , using MCOL , in which case you will need better evidence and learn what its about

    you coud email a SAR to their DPO with a copy of the V5C ttached , to obtain all your data, including the missing documents

    check that your V5C is up to dsate and has your current address on it , dont assume , get it out and check it, asap

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Why did you respond to MB before reading here, what you need to do?  Have you now read the NEWBIES thread?

    AND - please now make a real difference - A TASK FOR SEPTEMBER.

    The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

    You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.  

    And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

    Please be heard.  You can bet the hundreds of PPCs will be commenting.

  • The situation is this came out of the blue 6 weeks AFTER they said it happened so as they say the 14 and 28 day options have lapsed and l didnt respond its now £155.
    I NEVER SAW the first letter and the one l did get is 6 weeks after the date they say happened.
     The issue is it seems to be my car n reg but l cant see who was driving and no one is accepting liability.
     I cant recall where l was or what l was doing on that date and l I genuinely dont know who may have been driving.
    I wish the pic was clearer so l could sort this out.  Im concerned they will tie me in knots as my memory isn't great now  days either. 
    My health isnt great due to my disability but l hate this sort of thing happening to me. My wife said l should just have paid it but it seems to have escalated from 60 then 100 and now £155 without my knowledge. Now its a rock n a hard place tbh.

    What did you say in your first correspondence with them?  Let us see exactly what you wrote.

    Have you had a rejection from MB and with it a POPLA code?

    So, they could only hold the driver liable (if the PCN arrived late), and yet you appealed fessing up to who that driver was?  Throwing out the protection that you had as keeper, so that the 14/28 days now don't matter?

  • Thanks everyone. Im not sure how to put the email l sent them to show you as lm not tec savvy as an ol git of 67.
    I will try to copy n paste so you can see.it. or do l have to do something else etc.

     Just to be clear.
    I haven't appealed as l didnt see the letter untill roughly 6 weeks after the event. I never EVER   SAID I WAS DRIVING but said l didnt know who was and l couldnt remember where l could have been on a specific date n time due to the time elapsed. 
    Ive not fessed up to a thing as l dont know about it tbh.
     I will try n paste the email if thats ok and safe to do so..
     Thanks for the feed back though.
    Ive sent another to say l wont pay so dont keep adding on charges as they know l wont pay and if they still want to peruse it to go to the small claims court.
