  • and as per the previous thread , Care state that there agreement is direct with side owner , managing agent has no say 

    cares contract is with  the Landowner who is  is South Tyneside Borough Council
    I have found that it is owned by M7 Real Estate, I have tried to contact them but maybe I should give the council a call as well just to be sure.

    Sorry I mean to check if they own the land, once I know this I will contact them by email about the PCN.

    Local council planning portal usually (well ours does) allows you to inspect past planning applications,  You might have to sign up and log in.

    The planning application number is in a thread on this site but I cant find it.

    OMG - EIGHT PAGES OF POSTS?  This is completely unnecessary.

    Stop going round in circles and just do a quick landowner complaint and then do POPLA as per what BrownTrout said!    There is no evidence that the driver left the sote.  You win at POPLA. 

    It should never need even two pages to disucss this simple case, let alone eight!

  • I am about to send my appeal as per the newbies thread, as suggested I have added a paragraph at the bottom to advise that I am attaching a copy of bank transactions. Could I get a quick opinion on whether this is correct?


    Re PCN number: 503215

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.


    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.


    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.


    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.


    In order to resolve the dispute I attach copies of the drivers bank transactions that day as they were a genuine customer.
