Planning Application - Neighbour Taking Photographs without Permission

Options
Not sure if anyone can help us & may not be the correct place to post but... we are looking at buying an old barn to do up & live in. We have put in a planning application & a neighbour has gone onto private property, taken lots of pictures & posted them online, including the Local Authority planning website.. Is he allowed to do this & if not, any suggestions about how to get them taken down?
Any comments, very much appreciated.
Thank you.

Who's land did he go on to take pictures?

That said, anyone can photograph anything really, so you're argument is around trespass; but with no loss it's not going further.

As you do not own the barn or the property I am not sure there is a lot you can do.  Why would posting the photos online course you any concern?

The Planners will not be interested in a dispute over the provenance of images, and will instead focus on the substantive planning issue.  Focus on answering any significant issues in what I assume is their objection, or more sensibly have your architect/planning consultant do so, and be as dispassionate as possible.
Health Warning: I am happy to occasionally comment on building matters on the forum. However it is simply not possible to give comprehensive professional technical advice on an internet forum. Any comments made are therefore only of a general nature to point you in what is hopefully the right direction.

The barn belongs to my parents so I'm posting on their behalf.  It's posting pictures online alot of our possessions. The barn is open so there is a security issue....I guess something similar would be would you want someone posting the contents of your garage/workshop/shed online when there's no way to secure it?

    Perhaps close it then?

There's no inherent right to have photos removed. He owns them, and can do as he wishes with them

Not really, but there wouldn't be anything I could do about it.

It's really concerning if this is legal. If it is, what would stop someone from taking pictures of your home when you're not there? I don't know the law around this but I'd seek some help from a professional at this point. It should be a breach of privacy.

Nothing beyond your own security precautions. Perfectly legal for someone to stand in a public place (or an adjoining property) and take a photo of your house. If they walk up your garden path and you want them to leave you can of course ask them to, but there's nothing specific you can do about photos taken while they're there.

if someone trespasses to take photos not visible from a public space and then posts them onto a public forum such that the owners insurance increases due to security issues, would the owner then be able to sue for damages, ie the increased insurance cost?

Can you secure the land better to prevent trespass?
