Hi debtfree, The FOS ask for bank statements and credit check paperwork if you have it . Makes the claim easier to prove.:)0

Hi All, There are some encouraging claim success posts on DebtCamel.co.uk take a look. Wonga loans seem to be the best at responding still. People are getting very frustrated with QQ and PDUK a tactic that is working it seems, they are even trying to ignore the FO. I hope these 2 companies get what they deserve for their ignorance and delaying tactics.0

I would recommend getting a downloadable version of your credit report and sending this to the FO with your complaint. This will help them assess the time line, and if the loans were issued after you experienced defaults on your other borrowings, this will help to show how irresponsible the payday lenders were. Your query raised several questions on what loan affordability is based on and what statutory checks are processed before assessing credit approval. Please be advised of the following information in relation to your query:
-We processed a credit check, the search id: {3CC33B91-3D12-48CB-9775-516F5401988D} confirms one of the affordability checks that were ran. You can find additional information on checks by contacting Callcredit which is one of the Credit Reporting Agencies we use.
-We also run various checks, which include but are not limited to, affordability assessment based on current financial commitments, as well as verifying any personal details provided on the application.
-After the application was submitted, we send our customers an email which contains the pre-contractual agreement and also contains a hyperlink that leads to an audio version for your convenience.
-Prior to making a lending decision, your loan application is reviewed and all of the information discussed above is analyzed and taken into consideration.
-Once that information is reviewed, we make a decision and subsequently contact the consumer to advise of the final credit decision.
After careful review of your account and the information you submitted at the time of your application, we have determined that we diligently followed our processes and conducted a credit and affordability assessment on each credit application that was granted. Little update from me.
I'm still waiting for a FO response on 3 of my complaints, however I have had notification of the FO opinion on one of them. I escalated 4 complaints to the FO about 2 weeks ago so they clearly are looking into the Payday lenders much sooner than other complaints.
On Friday, I had a phone call with a lady from the FO who initially said her opinion on Uncle Buck was that because they could prove they had run a 'call credit' reference they hadn't done anything wrong. I pleaded with her to review my credit file which I had attached to my original complaint.
On Monday, she called back to say that she had changed her opinion based on the 5 defaults on my file prior to any loans being issued by Uncle Buck. She wouldn't have had access to this information if I had not sent my credit report. She felt they should therefore have been able to see that I was in financial difficulty and I should be refunded all interest and charges. Uncle buck have the option to appeal her decision but I doubt they will.
If you were genuinely in financial difficulty and you think the lender should have seen it in the credit referencing process send both the lender and the FO a copy of your credit file. This is so so so powerful. Its my biggest piece of advice.
I'm not sure how much I paid in interest to Uncle Buck but I had 6 loans with them. I suspect it will be about £400. I am just waiting for them to get in touch to make the repayment.

I have downloaded my credit report from experian which is very embarrassing as it shows I owed everyone money and kept missing payments and gaining defaults prior to getting PDL. Wish I had, had more sense at the time than to get them but we learn the hard way sometimes.0 -

Thought I would jus pop in to update you. I have had the generic email already so as i had a free few minutes I have sent one back asking for it to be 'escalated to the final response team' and tht if i don't hear anything back in 8 weeks i will assume that the generic email is their final response and will take my complaint to FO.Don’t put it down - put it away!

For people who have yet to put in a claim:
Remember, many of these complaints are by people who didn't default on their loans, but were trapped in a cycle of borrowing over and over just to pay back the previous amounts. As the Debt Camel website states, people have been issued refunds even if they have never defaulted because they were lent unaffordable amounts of money in such a way that they became dependent on borrowing money as soon as they had just paid it off.
I am one of those people who were continually issued loans, back to back. After I paid the loan in full, I couldn't survive until my next payday without borrowing another amount of money.0
