Usually you can claim for historic charges up to six years ago, or further back if you have evidence of them.
You also have to be in financial difficulty, which is also the case, whats stopping you ?
Hi sourcrates
Can i still claim? i probably missed out on my major charges as they were around 2007 onwards. Although i have had charges in last 6 years but not too many if im correct.
Also i still have not recieved any reply from wonga or cash genie regarding my statement of account. Sent 2 emails to each so far and nothing. Is it woryh a 3rd email or complain to the relevent bodies?DEBT FREE AS OF 28/6/17 :j:beer:0 -
It seems like a majority of these complaints end up going to the FoS, would that be fair comment?
Also I traced the issue of loans through either my online bank statements (going back 7 years which is pretty good for RBS I thought) and through checking my credit reports for accounts opened and closed with these lenders.
I have made it clear in the first paragraph of the letter that these numbers/dates are not definitive and that there may be loans out with the dates and that I expect them to conduct a full & through review of the entire account. Question being, if they end up with the FoS will that be enough to ensure all bases are covered (so to speak)?
Advice welcome.0 -
The FOS Adjudicators do a thorough job if they have all the information required to look into complaints. I always advise people to get copies of their bank statements ( 6 years ) and credit report, this speeds up the process and is invaluable to the Adjudicator.:cool:0

In order to be successful with the FOS, you need to show the loans you had led to financial hardship, so for example, if you were constantly repaying and re-borrowing, or you had payment plans in place, but were then lent to again, constantly rolling over loans, things like that.
If you have a record of good repayment, and gaps between borrowing, you are less likely to succeed.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. :j woo hoo, finally have an adjudicator!!!
Had a call from MMT this morning saying Wonga had tried to stall by stating they couldn't give the adjudicator account statements for 7-12 weeks...just as well they had emailed them to me on 18th August then isn't it :rotfl:
So far this has dragged on for18 weeks and counting  just awaiting a call from the adjudicator so I can put my point across.
I would say that having to take a debt relief order because of the PDL's is as much hardship as you could get!0 -

Thanks Sourcrates.
Reviewing the bank statements shows that loans were repaid and then retaken sometimes on the same day and often within a week of repayment, several transactions also show roll overs of debt. The bank statements also show borrowing from multiple pay day lenders at various times.
Further to that review of bank statements if they had been requested would have shown up my chronic issues throughout the period with gambling.
My credit report will show at times chronic mortgage and secured loan arrears as well as a very very poor credit score.
As I said earlier I accept I should never have applied to borrow the money but these companies willingness to approve me far from helping my situation just made it ten times worse.
Thanks again for your input though, I'll keep viewers of this board abreast of any developments.0 -
Hi
How many requests for a Statement of account do you think is fair to make without response?
I have made 2 in the last 7 days and Wonga have not responded or acknowledged my emails. I am thinking of making a final request before complaining to relevant bodies.
Who will i esculate this to if i do not hear any response this time round?

I have told people to complain to the FCA , easy on line complaint service. If everyone who has had issues with PDL ignoring and avoiding complaints, completes a on line complaint maybe something will be done about it. Just google Financial Conduct Authority:cool:0

Hi Leigh
I am in the same boat with Wonga. After sending 2 requests for a SOA, I eventually forwarded my emails to their customer care email address rather than complaints. A day or 2 later I received a stock response apologising for the delay and saying they will produce my SOA as soon as they can.
I am currently pursuing several complaints with PDLs after falling deep into the cycle back in 2010.
So far Lending Stream have offered me £317.25 which is half the interest that I paid on my loans from them and they have admitted there were procedural errors in processing my applications. I have gone back to them declining their offer as I calculate that the full interest + 8% p.a. since then comes to £940. I have said I would accept an offer upwards of £750 otherwise I will be going to the FOS.0 -

The same happened with me. In the end, I gave up waiting for an email and called them, telling them that I had emailed them and still hadn't had a reply. They sent the SOA to me within the hour0
