    Smart have been pretty active in court in Scotland in the last year. But only for multiple ticket cases. It's just not cost effective to pursue a single ticket due to the high up front costs in getting a claim up and running and the fact that no costs at all are allowed for claims under £300.

    Has anyone told CST this as they are stupid enough to think DRP instructed them ???
    And is it true that CST is run by a woman who is clueless

    The Simple Procedure process prohibits any costs at all being recovered for any claim under £300. This is designed to stop court being flooded by claims for trivial amounts.
    If only it was such the case in E/W. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Oxymoron? The procedure sounds far more complicated than MCOL. 😂😂
    As it should be. MCOL is far too easy to get a default judgement if you move house - all you need is proof of posting. No need to bother if its the correct address. Claim forms should all be proof of service, not posting. The other stuff down the line can be proof of posting but not the initial claim form.


    As a Scottish resident I am glad that this is the case. I was merely poking fun at the name. :)

    Just a quick update to let you know... there's been no update. I sent my initial SAR request email and covering letter to the PPC and CST Law respectively on 12th November.

    I received confirmation from the PPC that my SAR request had been passed on to their Data Protection Officer on 18th November, but have received no correspondence since. I've received no return correspondence at all from CST Law since my initial email on 12th November. 

    As I say, thought I'd just update you all on the situation, especially given that the 30 day response period has lapsed.

    EDIT: Sorry, my response from the PPC was on 18th of November, not 18th December as stated - have updated accordingly.

    Just a quick update to let you know... there's been no update. I sent my initial SAR request email and covering letter to the PPC and CST Law respectively on 12th November.

    I received confirmation from the PPC that my SAR request had been passed on to their Data Protection Officer on 18th December, but have received no correspondence since. I've received no return correspondence at all from CST Law since my initial email on 12th November. 

    As I say, thought I'd just update you all on the situation, especially given that the 30 day response period has lapsed.

    Then now you need to send their Data Protection Officer an email giving them seven days to comply with their statutory obligation, warning them that you will report their failings to the Information Commissioner's Office without further notice.

    Indeed - I wouldn't mind if this truly meant I'd never hear from them again, although I'm not holding my breath, in fact I expect another LBC through the post in about 3 months' time with no acknowledgement of my email correspondence being made...!

    The way CST behave, that could well happen and then you start all over again with the questions  they cannot answer.   Will CST expose their utter stupidity to a judge , would love to see it
