With the NTK they have said that they applied to the DVLA to get the details but they didn't reply. I have 2 SAR's from the DVLA that confirm they didn't.They had my address etc from when I appealed the ticket so no details were obtained from the DVLA. Is that what would make the NTK compliant?1

Yes, the POFA Sch4 says a keeper can only be held liable if the data was obtained from the Secretary of State (DVLA). But TBH the POFA Sch4 is badly drafted and a Judge might not be impressed with this idea.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
