They wer always going to be able to structure around your WS, thats what the rep on the day does. So dont go on about unfair

Well you can of course write to the court, and question the likelihood of 2 pieces of post going missing - the initial allocation to your local court, and the letter giving the hearing - and the diligence of a professional firm used to handling court claims in not querying the lack of contact in multiple months. THis smacks more of their mishandling of the claim internally than it does post truly going missing.3

Afternoon everyone. So I'm still yet to hear anything in relation to my case which is due by video conference on 13/11/2020. I still haven't received their witness statement which was due by 2pm on 01/10/20 & I've had no reply to their email to the court requesting an extension. A court fee of £25 was also due to be paid by 2pm on 16/10/2020 by the claimant & I have no idea if that's been paid. MCOL hasn't been updated since 30/07/2020 when the case was transferred to my local court.I don't know if I should be emailing the court or am I better off leaving it as they may never sent the witness statement & therefore the case would be thrown out?0

Check with your local court
MCOL does not get updated once it is transferred , they have no involvement once it leaves them for the nominated Court3 -

Thank you. Yes I've been checking my email including the junk file. The only email I've had is on 06/10/2020 from the claimant to the court with myself copied in asking for an extension as they missed the deadline for the witness statement saying they didn't receive any request in the post.Am I better off leaving it for now? If I don't get the statement by the court date then surely it can't go ahead & it'll be all cancelled?Or should I definitely get in touch with the court to question it asap?0

I would be contacting the court , because we cannot answer your questions , only they can and inaction can put you at a disadvantage
I don't know why you said it cannot go ahead , we have seen court cases go ahead despite paperwork not being filed , providing the fee has been paid3
