It doesn't mean it won't work, just means that the whole claim may not be struck out as an abuse of process BUT (if my reading of it is correct) they should not be able to claim the additional "debt management" costs. It was never a defence against the PCN always was a way to prevent the additional costs being awarded if the claimant won and the defence will have to rely on other legal/technical arguments.5

No, it just means they got a single appeal. Oh no.
Also your defence isnt solely abuse of process...4 -
As mentioned above and as can be seen in the appeal by b w legal linked this morning by brown trout , the abuse of process only addresses the additional charges and does NOT address the core issues , the PCN or PCN s that were issued
So there are more issues in the whole , abuse of process about the charges , plus the actual issue regarding the PCN
Your defence should have addressed each and every issue , so a judge can look at each one and make a judgment about each one , separately if necessary
I now expect judges to consider the PCN and court case even if they don't strike out the spurious charges at the very start.
They are unlikely to strike out an entire claim without considering each section , due to that appeal but all it means is they consider all points listed in the case, even if they do strike out the abuse of process charges4 -

It's the ccbcaq address that orangebanana mentioned , the one KeithP has posted hundreds of times on here so it's not that elusive , check the newbies FAQ sticky thread because it's in there or linked in there2
