    You may wish to google how may roads in the UK share the same name to highlight the significance of the failure to specify the relevant land.

    You may wish to highlight the ppcs undoubted failure in the particulars (and if applicable the statement you receive)
    1. to specify the land;
    2. To explain where the vehicle was parked and if that location falls within the land
    3. To adduce a statement from anyone with actual knowledge of the circumstances in which the ticket was issued or who has familiarity with the site.

    There is no revised POFA.  It's not been changed.

    |Double check your letter. There is AL:WAYS a deadline specified. It will likely be on the back and may talk about all documents being filed X days before.

    Hi all, the defendant has a court hearing date and wants to know when filing WS:

    1. Which versions of schedule 4 of the POFA to use, original (As enacted) or the latest available (Revised) to file?

    2. Since a copy of Beavis case is going to be filed with WS, is it necessary to also file a copy of paragraphs  98, 193 & 198 of Parking Eye v Beavis?

    3. There is no need to re-send a copy of the defence form, is there?

    4. Is including a copy of Excel v Wilkinson case advisable?

    1. There is no PoFA revision. There's no need to copy it into the WS (and only Schedule 4 if you do), the Judge should have access to it on his/her laptop in any case. Perhaps just have your own copy with you and quote from it as necessary. I take it you understand which part(s) are the relevant ones and how they impact your case?

    2. Surely you're not going to attach the whole PE v Beavis judgment, it's well over 200 pages long?  Just copy the pages which include the three paragraphs you are referencing. Absolutely sufficient.

    3. Correct. The parties already have those, but you make sure you have your own to hand for your reference at the hearing.

    4. Definitely if there is a spurious added amount (£60/£70) to the basic £100 parking charge. It might just persuade the Judge to strike out the whole case (as the Judge did in Wilkinson), but essentially it is to be used to ward off the add on charge.

    Good luck.

    Hi all, defendant needs to copy paragraphs 98, 193 & 198 of Parking Eye v Beavis court case for the final court hearing. But the case document comprises only 52 paragraphs in 17 pages, is this the wrong version? If yes, any help finding the right version would be ppreciated.

    Hi all, defendant wants to double check what is the correct way to submit case costs, with the WS or later on when the case has been concluded?

    With the WS. Too late after the hearing. You'll find examples of how to lay it out via the NEWBIES FAQ sticky, second post.
