Hi all, this is just to let you know that this case which started in 2019 have now been concluded in this year after several court hearing postponements. The claimant against the RK (defendant) was dismissed as the contravention location given in the PCN was insufficiently identified for the purpose of Protection Freedom Act (2013) schedule 4, paragraph 9(2)(a) and was therefore invalid and/or unforceable.

This is fantastic forum and thank you for all your help.

That is a great way to win a court hearing!  Quite unusual. Well done and also well done to a Judge who understood the POFA.

    ANOTHER ONE BITES THE DUST!

Please please come back to take part in the final Public Consultation to change and cement the law and ban the fake + £70 extortionate debt 'fees'.

Opens soon - July, we hear.  Come back and be heard by the Government.  Your only chance.

Read, bookmark and set email alerts for new posts on the 2022 replies in the top sticky thread by MSE_JC.  We will tell everyone there when the Public Consultation opens.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You can ask a board guide to close it so the information is still available but nobody else can post on it. Alternatively, just leave it and it will drop off the bottom, but still be available for people to find.

What would be useful is if you could post the name of the judge, the case number, the date, the location of the court, and your title plus surname initial, and judge's determination/judgment. That way the regulars can quote the judgement and the case without revealing your identity.
