I may have said this earlier in this thread, but this is turning out like Pirates of the Caribbean ... The Pirate's Code is more of a guideline than an actual code. 🙄3

When this actually happens, at least it scuppers the Gladstones / IAS world plan of domination and I can see no reason why PPC's would continue with the IAS ?
If the BPA want to do something useful in their current code, they should stop giving advice that PPC's can add on extra amounts which is totally against the Supreme court, POFA2012 and double recovery. This has led to the legals thinking it is legal and in turn the courts who abide by the law, disagree ... hence the birth of Abuse of Process. It has indeed led to immense timewasting for the courts.
The fact is that the courts know better than the ATA's and that is why when the legals go to court, they are now surrounded by a pack of lions ready to pounce.
In my opinion, thanks to Judges Taylor and Grant in Southampton, this has formed our own code of practice. Whilst we only see a small number here, more and more courts take the action required and that has resulted in a minefield for fake claimers.

Over the weekend I emailed my MP regarding the status of the new Code of Practice, and requested the following:-"Is it possible for you to ascertain:-1) is the new CoP now completed?2) if not, when is it likely to be available for comment by the general public?3) when it is available will the general public be able to comment at the same time as any other entity?4) if it is in fact now available has it been sent to/seen by other entities other than the general public?5) if no. (4) is applicable can you enquire as to whom these parties are?"The reply for what it is worth:-"I am not sure I am able to answer all your questions but as I sure you know the Act enables the creation of a single code of practice for the management of private car parks. This will go a long way towards tackling rogue private parking operators by providing clarity and consistency across the sector for both parking operators and motorists, as well as driving up standards. As the British Parking Association has argued, a single code “is important to ensure that unscrupulous providers don’t undermine the parking sector with bad practice”.In terms of the Code itself the British Standards Institution has produced a final draft of the Code and a public consultation will take place in due course. The Government has previously committed to developing the final Code this year and so I hope to see this consultation launch.I don’t know about other parties with regards to this consultation but MHCLG have already engaged with an extensive range of stakeholders during the Parliamentary passage of the Act.
