    Just been looking at the CMA's guidance on unfair contract terms. I've stumbled across the following in their historic examples of previous unfair terms:
    Group 6(a): Unequal cancellation clauses
    Schedule 2, paragraph 1, states that terms may be unfair if they have the object or effect of: (f) authorising the seller or supplier to dissolve the contract on a discretionary basis where the same facility is not granted to the consumer …

    Original term
     The Seller … [may] cancel or rescind the Contract if the performance of its obligations under the Contract is in any way adversely affected by any cause whatsoever beyond the Seller's control including but not limited to the delays or defaults of the suppliers or the default of any sub- contractor, war, strike, lock-out, trade disputes, flood, accident to plant or machinery, shortage of materials or labour.

    Action taken
    Term deleted.

    In my opinion, this seems to be very similar to the clause in the Terms and Conditions that LHH are currently hiding behind and citing as the reason they are not liable for a refund.
    Anyone else of the same opinion?

    At last, I've found other poeple in the same boat with LHH Scotland. I had holiday cancelled by them due to government restrictions, I asked several times to rebook for 2021 but they refused and have also refused to refund the extortionate £832 deposit. I notice now on their most recent marketing email that booking from now on they will refund in full, less an administration fee, should the Government put the holiday house area or your own post code area, into a lockdown! We are now at a stalemate with them with regards to refunding our deposit.
  • I understand!  We have lost £1710 to LHH  .........  for nothing!  Go onto CMA website and fill in their online form (very easy) stating your grievance with LHH.  You can also go onto Trustpilot uk and put in a search for LHHScotland.  There have been many many reviews from dissatisfied customers.  Most of them have been flagged by LHH and deleted, but you should write a review anyway and add to the numbers.  We have questioned Trustpilot re deletions by LHH and await their response.  The positive reviews have been left by formal employees and their current solicitor!!  All people who have an interest in LHHScotland
  • Gosh, just logged back into this site after receiving a marketing email from LHH saying that their social media account had been taken down after abusive  comments from people who had never booked with LHH!  They’re having a laugh aren’t they?  
  • Ok so I’ve created a (private) Facebook Group for those affected by LHH’s refusal to give refunds - it’s called Letdown by LHH so please join!

  • Hi Queen Lizzie.  Great news!  I also was unable to find the page on Facebook.  I put in a search for  -  Letdown by LHH.  Is this wrong?

    Gosh, just logged back into this site after receiving a marketing email from LHH saying that their social media account had been taken down after abusive  comments from people who had never booked with LHH!  They’re having a laugh aren’t they?  
    Their marketing email also says:
    "For any new bookings, with an entry date between July and December 2020, we will refund in full, less an administration fee, should the Government put the holiday house area or your own post code area, into a lockdown."
    Bit of a kick in the teeth!

    Unless they go bust of course,  in which case you are covered by credit card no matter how long ago you booked.   Unfortunately booked last year so not eligible for chargeback
    I read somewhere that the time limit for chargeback runs from the start date of your holiday, I'll try and find where I read it
