Can I claim on overfilling an engine with oil, that was an accident

I have a diesel car and had a breakdown, where it has been diagnosed after an engine strip down as hydraulic failure. Do I have a claim?

    A claim on what? Insurance, a warranty?

    As the OP is considering the overfilling to be an accident, I'm guessing an insurance claim.  Warranties are for parts failures rather than accidents.
    I doubt an insurance policy would pay a claim for damage caused by improper operation of the vehicle, but what is there to lose?  Call the insurance company and ask.

    The oil level can rise if the car has some failed DPF regerations.  So it may not have been over-filled?

    But then again even if that were the case the OP hadn't been regularly checking the oil level as per the user manual otherwise they'd have seen it above the maximum. To hydraulic an engine takes a considerable amount above the maximum mark.
    Either way no insurance company is going to pay out for a hydrauliced engine, it's a mechanical failure caused by owner neglect.

    If you google "garage overfilled oil" it comes back with 497000 hits. Many tales of woe. Are you saying that doesn't happen?

    And the vast majority of those results are articles from organisations like the AA telling people what to do if THEY put too much oil in their car.
    I know you've never worked in a garage Fred and your sum total of knowledge comes from people doing Youtube videos on their driveway but in the garage I worked in we used either jugs where we'd put in what the car's capacity was or we'd use hose feed delivery systems where you'd put in on a digital display the amount you wanted in. Also unlike you Fred a mechanic would check the dipstick once they'd put the oil in.
