Sadly, it must be said: sorry but no wonder you lost, if you submitted no evidence.  Defence was not your only job.

If the only party who submitted evidence was the Claimant then they were almost bound to win, because (if I am right) you had no witness evidence for the poor Judge to work with.

Last thing I said to you in February was:

"you won't see the landowner authority or signage until months down the line when they send their witness statement and evidence.  You need to look closely at the 'Ltd' company names then."

You never came back.  Obviously, when they sent their WS bundle a few weeks before the hearing was when you had to send yours.  Your deadline was on the Hearing Order, as it will be for the second one!

You didn't ask us to look at your WS and evidence even though I gave you a heads up about that stage - and the NEWBIES thread clearly says how important that stage is and what to do.  And that defence is not enough...

What stage is this new one at, when's the hearing?

Done your WS & evidence bundle for this one yet?

DO NOT MENTION THE OTHER CLAIM.

You must pay that first one in full.

Would you like to see the defence and witness statement that I had submitted? it might help you determine why I lost and help me win the 2nd case which is for 14 tickets (a lot of money in total)

No, a defence is not a WS.  Sadly you only sent a defence which is never enough.

Given you also say that you didn't attend the hearing (and had supplied no WS or evidence) you were sadly allowing yourself to lose.  Big time.  Including being clobbered with costs, probably.

There was no point defending it, sadly.  You could have taken the baby and this decision was effectively you agreeing to pay them almost £300.

You'd have been better contacting BW and settling the week before...would have been cheaper than losing at a hearing you couldn't attend.

Please make sure you don't make those 2 mistakes again with the huge money at stake:

1.  You MUST do a WS bundle before the hearing.

2.  You MUST attend the hearing (you can take a baby).

I did send a witness statement, as well as the defence, 2 separate files.

So I've received a 2nd bundle (not a letter of claim) but I haven't defended it yet as there's still time

A 'letter of claim' is not a claim form.

Neither of those are a 'bundle'.

I've received a folder with the letter from the court at the front, and the other partys claim, witness statement etc. I received this for the 1st case, which I defended by sending my defence and witness statement, and lost. And now I've received the same folder for the 2nd claim, which I'm due to defend

Sorry for the confusion.
So the 2nd bundle was for the 1st hearing, the reason why I had 2 was due to the 1st one being rescheduled

The 2nd hearing date is 31st August and I haven't received the bundle for this one yet

As these parking notices were sent together but split into 2 different court hearings, is there any point mentioning cause of action estoppel again? To stop this 2nd hearing from going ahead

Yes I used the forum template and changed some words, plus added some bits

The deadline is a week before the hearing of 31st August
