Since my friend has been so distressed, I have been dragged a little way in to the murky world of PPCs in order to support her. What really struck me on looking through the HUGE amount of documentation she has, is the disingenuous photos submitted as evidence to the court - photos taken of the area from long before her 'incident', close up photos of terms and conditions, taken to make them look large and visible, when in reality they are way above head height of an average size person and the t&cis are in tiny writing, photos of the entrance sign facing incoming cars - that is shocking as the photos dated on her phone clearly show the entrance sign twisted and facing inwards. I do not understand how such evidence as OPS submitted to a court of law, can be allowed. It sounds to me like the first judge saw through the trickery and the appeal judge unfortunately was not au fait with what happens in these cases. Anyhow, these are things to look out for, for anyone forced to go to court. Everyone here though does sound like they know all these things already.

It sounds as if the car park is a hot spot. I expect the first judge was fed up with seeing claims from this PPC.
I don't know whether this is a good idea or not but some media coverage of the case might help with the crowdfunding. Daily Mail are very anti-parking companies especially if the car park is a hot spot. I don't know if people get paid for stories.
There was a story a little while ago of a wounded veteran who had lost both his legs in Afghanistan. His disabled badge was being renewed and he lost his case. I can only think that it must have been on papers. Hopefully from the media coverage he may have had an offer of pro bono from a barrister. He was appealing but I don't know the outcome.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

We all feel for your friend and hope the crowd funding works.
Judge Harvey made the right decision and was over ruled by an HHJ who clearly has failed in understanding the parking scam. Via email, I have conversed with Mr Harvey a few times, I know others have as well. Mr Harvey is a nice man, only interested in fairness. His boss has failed and that is of great concern.
Take the Beavis case, Barry won in the High Court and Parking Eye took it to the Supreme Court.
"The Lords" in the Supreme Court made a ruling which created such a huge problem for the county courts which they don't know how to handle
I mean when you watch the House of Lords on TV, many are fast asleep and when they are awake they are full of waffle ? ... This illness has drifted down to the county courts
Until the court system is updated, judges will still make huge and stupid mistakes
The parking industry is a scam which our legal system has yet to wake up to.6 -

Barry Beavis lost in the County Court, before HHJ Moloney. He appealed, and the case was leapfrogged to the Court of Appeal. It was never heard in the High Court, at any stage. He lost at the COA, and then appealed to the Supreme Court, where their Lordships ruled 6-1 in Parking Eye's favour.
And the House of Lords has had nothing to do with it since 2005, when the Supreme Court was created.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.4 -

How can the Minister of State for Justice know what a regular Joe might come up against and how hard it is to fight their corner?
I know ..... Robert Buckland stormed off "Good Morning Britain" ... he failed to answer questions and when told the interview was over ... he got the hump ??
It's called "A Boris problem"3
