Ooh you really don't understand this, do you?
You fail to differentiate between (or perhaps to understand) that professional indemnity cover (for negligence) is different to litigation insurance in case a claim is lost.
I rather suspect that on a small claims case it would be difficult to secure commercial cover for loss. There is no suggestion of professional negligence. First, the defendant and her assistants were not legal professionals and second, a mere loss does not equal negligence to the Bolam standard in any event.
Very easy to make crass assertions following a successful ruling, but let's not overlook that a loss preceded it and the defendant is by no means the first person in the world who finds the costs of litigation exceed the issues in dispute. I mean, Jarndyce....
I'd be interested in the trial ratio of the ppcs for wins/losses and incurred costs if you care to publish (as distinct from default judgments).
Above all else most people understand that you can win without being a tool. It's unedifying. But apparently that's too difficult.9 -

I assume that is the type of insurance that companies are taking out in bringing Neil Woodford and HL to court.
Really though small claims should be what they say on the tin otherwise the ordinary person will be put off seeking justice and litigation will be just for the people that can afford it.

Your right, it is 'no skin off my nose; however, it should be the 'advisors' that foot the bill; as it's them that got the motorist into this mess by using her to fight their cause.
