Hello everyone, I thought I'd give another update on the fence/decking nightmare. So lots has happened since my last update. I've had to put the decking situation on hold as the fence situation took a pretty sinister turn. We had workmen arrive to do some work on our wall, this wall runs inside our boundary and is concreted to our steps that lead into our garden, these steps are concreted to our house. She had her grey plastic fence erected so it runs in line with our wall, clearly in our garden. We were going to live with it to save the peace but when we started working on our wall her and her daughter came out screaming that it was their wall and so were the steps and they would be taking them. They then stood swearing in my husbands face from less than a foot away, the 3 workmen all witnessed this and said it was disgusting, so I contacted the mediator again and told him. This was in June, he came out and told us and her that the wall was ours and her fence was trespassing. She disputed it and went to a solicitor. To cut a long story short, shes tried everything and is about £6000 down so far, but her solicitor finally conceded that her fence will have to come down as we have a Determined Boundary registered at the LR. During the last few months she's thrown weedkiller over the fence, killing 3 of my trees, various shrubs and parts of the lawn. Also, about 3 weeks ago her daughter painted a huge pentagram on the lawn in gloss paint, then 3 of them dressed in stupid black duffel coats stood around it chanting. In the middle was a casserole dish, obviously meant to be a cauldron, which they set fire to. All this was aimed at us. My sister pointed out that this could have scared someone half to death. We have the whole thing on film and I'm considering going to the police and reporting them for harassment. So regarding the decking, I have discovered more by talking to other neighbours and it appears that just before we moved in 2 years ago she extended it out by about 3 feet. So I went looking on the Internet and as she used to run her house as a B&B I found photos of how it used to look, so I now have photos of it before she extended it. Now the fence debacle is over I will be going to the planning office about her decking. Maybe if she hadn't been so spiteful we wouldn't be where we are now. What?! You are considering going to the police?!
As said above, the weedkiller was criminal damage and, I suspect, criminal trespass (they effectively came on to your land). The shouting and swearing is - what? - harassment at 'best' and threatening behaviour almost certainly; "The offender is determined guilty if they are found to have intended to cause such offence by the use of words, behaviour or written signs and other representations" (like trying to excise you via the occult... :-) )
Be brave, be strong. You know this needs to be tackled now, and bullies only respond to one thing. Record, note down, record. Let them rant, and you be totally reasonable - most bullies simply cannot cope with that as they expect - hope- to bring you down to their level of behaviour.
Have your local Bobby on speed dial and do not hesitate to call them for each and every unacceptable bit of behaviour from them.
Good luck with the Planning Dept, but you do have tree screening as a fall back - although it'll now require CCTV and possibly soil samples to be taken at regular intervals. (Do a Google for 'chemical testing' or similar, and have all this sort of thing ready for if it's needed.)0 -

I have had all my photos printed and ill take them along to the police next week, and then I'm off to the planning department.
